An act against the law is an act that violates the rights of others, the legal obligations of the perpetrator and is contrary to the norms contained in society such as the norms of decency and propriety which results in a loss. In this study, the author analyzes a PMH case based on a decision at the District Court level only, although this case continues up to the Supreme Court level. This research will discuss the legal consequences of illegal acts against the use of land and buildings without permission, as well as discuss the judges' considerations in providing material and immaterial damages to the Defendants, especially in the District Court Decision Number 465 / PDT.G / 2015 /PN.JKT.PST. This research is a descriptive study by collecting various primary and secondary legal materials. After that, the author analyzes using qualitative analysis with a case approach and a statutory approach. The results of the research and analysis explain that the legal consequences of unlawful actions related to the use of land and buildings without a permit are losses suffered by the Plaintiff. Judges' considerations in determining material and immaterial damages, namely judges are guided by the principle of proportionality so that the judge does not grant immaterial claims submitted by the Plaintiff. In his decision the judge stated that the Defendant had committed an illegal act and had to pay compensation jointly and severally to the Plaintiff in the amount of Rp. 360,000,000 (Three Hundred Sixty Million Rupiah).
