Abstract

Membanjirnya produk kosmetik yang dihasilkan pelaku usaha baik dalam dan luar negri yang beredar di Indonesia secara online, di satu sisi memberikan kemudahan bagi konsumen untuk memilik produksi barang dan jasa sesuai dengan kebutuhannya, tetapi di lain pihak kondisi tersebut mengandung potensi pelaku usaha dalam memproduksi barang atau jasa tidak memperhatikan kesehaan, keselamatan, dan keamanan konsumen, bahkan tidak jarang pelaku usaha melakukan kejahatan terhadap konsumen, hanya karena keuntungan yang menjadi tujuan utamanya. Kondisi inilah mengakibatkan kedudukan pelaku usaha dan konsumen menjadi tidak seimbang dan konsumen berada pada posisi yang lemah. Maka dari itu, dalam penelitian ini akan melihat apakah bentuk perlindungan hukum terhadap konsumen ini mampu menguatkan kedudukan konsumen dalam transaksi khususnya elektronik. Penelitian ini menggunakan pendekatan Perundang-undangan dengan menggunakan dasar Undang-Undang No 8 Tahun 1999 Tentang Perlindungan Konsumen dan Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik. Dari hasil penelitian tersebut, dapat disimpulkan bahwa ketentuan mengenai tanggungjawab pelaku usaha dan bentuk perlidungan konsumen sudah diatur cukup jelas dalam peraturan perundang-undangan, namun, hal ini tidak sepenuhnya menjamin perlindungan ini berjalan lancar karena hal utama yang menjadi masalah adalah kurangnya kesadaran konsumen untuk melaporakan tindakan yang tidak seharusnya dilakukan pelaku usaha yang tentu menimbulkan kerugian bagi konsumen itu sendiri / Since many of cosmetic products produced by businesses both inside and outside the country that circulated in Indonesia via online, it makes easy for consumers to pick the production of goods and services according to their needs, but on the other hand, these conditions are potentially of efforts in producing goods or services do not pay attention to examples of health, safety, and security of consumers. There are even some businesses doing fraud to earn profit. These conditions resulted in the position of businesses and consumers become unbalanced and consumers are in a weak position. Therefore, in this study will look at is there legal protection of the consumer is able to strengthen the position of consumers in electronic transaction. Study by using the approach of legislation using the basic Law No. 8 of 1999 on Consumer Protection and Law No. 11 Year 2008 on Information and Electronic Transactions. it can be concluded that the provisions on the responsibility of businesses and forms of protection of consumers is set sufficiently clear in the legislation, but this is not fully guarantee because the main problem is there is a lack of consumer awareness to report to authorities about products that would cause harm to the consumer itself.
