Abstract
Perkembangan ekonomi global dan kemajuan teknologi yang begitu cepat berdampak pada timbulnya persaingan usaha yang begitu ketat dan terjadi hampir di semua sektor. Lingkungan yang sangat kompetitif ini menuntut dunia usaha untuk menyesuaikan dengan tuntutan pasar yang memerlukan tanggapan yang cepat dan fleksibel dalam meningkatkan pelayanan kepada pelanggan. Untuk itu diperlukan suatu perubahan struktural dalam pengelolaan usaha dengan memperkecil rentang kendali manajemen sehingga dapat menjadi lebih efektif, efisien dan produktif. Dalam kaitan ini dapat dimengerti apabila kemudian muncul kecenderungan perusahaan untuk menyerahkan sebagian pelaksanaan pekerjaan kepada perusahaan lain, satu bagian atau beberapa bagian kegiatan perusahaan kepada perusahaan lain melalui perjanjian pemborongan pekerjaan atau perjanjian penyediaan jasa pekerja/buruh.
Penelitian ini menggunakan pendekatan Perundang-undangan dengan menggunakan dasar hukum ketenagakerjaan yang berkaitan dengan outsourcing. Dari hasil penelitian tersebut, dapat disimpulkan bahwa ketentuan mengenai persyaratan perjanjian kerja sudah diatur cukup jelas dalam peraturan perundang- undangan, serta kepastian hubungan kerja bagi tenaga kerja outsouricng pun semakin jelas dengan adanya pengesahan peraturan yang baru tetapi tetap saja ada kekurangannya, karena pengawasan bagi praktik kerja ini masih sulit / Global economic developments and technological advances are so rapid impact on the emergence of competition is so tight and in nearly all sectors. This highly competitive environment requires businesses to adjust to the market demands that require rapid and flexible response in improving service to customers. This requires a structural change in the business management by reducing the control of management to be more effective, efficient and productive. so, it is understandable if it then appears the tendency of companies to outsource part of its work to other companies, one part or several parts of the company's activities to other companies through an agreement contract of work or agreement providing worker or labor.
This study uses the approach of legislation using the basic labor laws pertaining to outsourcing. From these results, it can be concluded that the provisions on the requirements of employment agreements is set sufficiently clear in the legislation, and certainty of outsourcing’s work relationship even more obvious with the new validation rules but this is didn’t work well, because the monitoring of working practices is still difficult
