The development of online business gives a big impact on humans in various daily activities. The banking era that was once a face to face, now turned into a virtual, the Financial Technology (FinTech) era. People who do not have a fixed bank account can easily make payment transactions, money transfers and other transactions even this is also an option for people who already have a bank account because it is much more practical and easy to do. In this thesis, the writer conducted a legal research and analyzed the legal materials which set the conditions concerning Financial Technology. The legal materials used in this study are The Regulatory of Financial Services Number 77/ Pojk.01/ 2016, About The Borrowing Loan Borrowing Services Based on Information Technology Or Fintech. The writer used qualitative analysis in this study. in this paper the authors hope the Government should continue to pursue the birth of this FinTech innovation through the generation of startups and cooperation between banking and technology Fintech. The ideals of the government to realize the cashless society certainly require strict regulators and supervision by Bank Indonesia and OJK to ensure that society is not harmed. Of course not apart from the rules of supervision on the security of personal data and protection for community transactions
