One of the most common and widely spread phenomena to occur in Regional Heads Elections is political dynasty, the exercise of political power by a group of people who have family ties. This raise concerns in the inequal political power distribution, the increment of the potential for abuse of power by the incumbents, and uneven level of playing field between the Regional Heads candidates, which then all results in the society’s immature political abilities. In handling these issues, the government enacted Law No. 8 of 2015 concerning the Amendment to Law No. 1 of 2015 concerning the Stipulation of Government Regulation in Lieu of Laws No. 1 of 2014 concerning the Governor, Regent, and Mayor Election into Law, in which Article 7 letter r prohibits the incumbent’s family members to join Regional Heads Election. However, the Constitutional Court through Constitutional Court Decision No. 33/PUU-XIII/2015 stated that the prohibition on political dynasty is discriminative and therefore unconstitutional.
