Abstract

Constitutionally the 1945 Constitution in Article 33 paragraph (3) states that "the earth, water, space and wealth contained in it controlled by the State and used as much as possible by the people's prosperity " it is clear that what is meant in article 33 of the 1945 Constitution is prosperity the people are the priority in the utilization of existing natural resources (Earth, water and space and the wealth contained in it), inside implement this in the field of land issued by UUPA. Stout problems relating to land, arising from remembering that land is a human need that is inseparable from other needs, and has a high economic value or selling value. Land problems that often occur have to do with legality or evidence ownership just call a certificate. BPN is a responsible body and is authorized to issue and cancel certificates. Many court decisions, especially the TUN Court, which clearly decided cancellation of Certificate, but its implementation has not been executed. Therefore with the background of these problems, the authors are interested in writing thesis proposal with the title: "Execution of the Decision of the State Administrative Court concerning Cancellation of Certificate (Case Study of Decision No. 43 / G / 2011 / PTUNPLG) ". / Secara konstitusional UUD 1945 dalam Pasal 33 ayat (3) yang menyatakan bahwa” Bumi, air, ruang angkasa serta kekayaan yang terkandung didalamnya dikuasai oleh Negara dan dipergunakan sebesar-besar kemakmuran rakyat” ini jelas bahwa yang di maksud pada pasal 33 UUD 1945 adalah kemakmuran rakyatlah yang utamakan dalam pemanfaatan sumber daya alam yang ada (Bumi, air dan ruang angkasa serta kekayaan yang terkandung didalamnya), dalam melaksanakan hal tersebut dibidang pertanahan dikeluarkan UUPA. Bayak permasalahan yang berkaitan dengan tanah, timbul oleh karena mengingat bahwa tanah merupakan suatu kebutuhan manusia yang tidak terlepas dari kebutuhankebutuhan lainya, serta memiliki nilai ekonomis atau nilai jual yang cukup tinggi. Permasalahan tanah yang sering terjadi ada kaitannya dengan legalitas atau bukti kepemilikan sebut saja sertipikat. BPN merupakan badan yang bertanggung jawab dan diberi wewenang untuk menerbitkan dan membatalkan Sertipikat. Banyak putusan pengadilan khususnya Pengadilan TUN yang dengan jelas memutuskan pembatalan Sertipikat, namun pelaksanaannya belum dieksekusi. Untuk itu dengan dilatar belakangi permasalahan ini maka penulis tertarik untuk menulis proposal tesis dengan judul : “Eksekusi Putusan Pengadilan Tata Usaha Negara tentang Pembatalan Sertipikat (Studi Kasus Putusan No. 43/G/2011/PTUNPLG)”.
