Abstract
Government Regulation No. 24 of 1997 on Land Registration, stressed that
any legal action that seeks to transfer land rights through sale and purchase can
only be registered if it is proved by deed made by PPAT. In practice in the
community, despite the purchase of land was carried out by the parties in front of
PPAT offen caused dispute, because there are legal defects in the sales and
purchase deed, the deed of sale can be canceled by a court decision. Therefore,
research on the legal protection for parties in sale and purchase transaction in front
of PPAT and responsibility of the deed which is made by PPAT proved to be
flawed law which resulted in the deed of sale was canceled by a court decision.
In this study, data collection was done by using a normative juridical
approach to legislation, especially concerning the sale and purchase of land rights.
From these results, it can be concluded that the purchase is legal according to the
law when the requirements of cash, vivid and real are fulfilled. substantive
requirements concerning the competence and authority of the parties, the
fulfillment of formal requirements such as buying and selling transaction is done
in front of PPAT and the transaction is compiled according to the laws and
regulations. PPAT's responsibility when proven guilty that cause the deed of sale
which made canceled by the court, PPAT can be subjected to administrative
sanctions, criminal sanctions and can be sued to pay damages to the injured party. / Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah,
menegaskan bahwa setiap perbuatan hukum yang bertujuan untuk memindahkan
hak atas tanah melalui jual beli hanya dapat didaftarkan jika dibuktikan dengan
akta yang dibuat oleh PPAT. Dalam prakteknya di masyarakat meskipun jual beli
tanah telah dilakukan oleh para pihak dihadapan PPAT sering menimbulkan
sengketa, karena terdapat cacat hukum pada pembuatan akta jual belinya,
berakibat akta jual beli tersebut dibatalkan oleh putusan pengadilan. Untuk itu
diperlukan penelitian mengenai perlindungan hukum bagi para pihak yang
melaksanakan transaksi jual beli dihadapan PPAT dan Tanggung jawab PPAT
atas akta jual beli yang dibuatnya apabila terbukti mengandung cacat hukum yang
mengakibatkan akta jual beli dibatalkan oleh putusan pengadilan.
Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan
pendekatan yuridis normatif pada peraturan perundang-undangan khususnya
mengenai jual beli hak atas tanah. Dari hasil penelitian tersebut, dapat
disimpulkan bahwa jual beli dinyatakan sah menurut hukum setelah terpenuhi
syarat tunai, terang dan riil, Syarat materiil yang menyangkut kecakapan dan
kewenangan para pihak, terpenuhinya syarat formil yaitu jual beli dilakukan
dihadapan PPAT serta pelaksanaanya dilakukan menurut ketentuan peraturan
perundang-undangan yang berlaku. Tanggung jawab PPAT yang terbukti bersalah
mengakibatkan akta jual beli yang dibuatnya dibatalkan pengadilan maka PPAT
dapat dikenakan sanksi administratif, sanksi pidana dan dapat dituntut membayar
ganti rugi kepada pihak yang dirugikan.
