War on Drugs is a global things nowadays. Besides Indonesia, the Philippines and Portugal are countries that have stated the war on drugs. In 2014, Indonesia's 7th President Joko Widodo declared the Emergency on Drugs in Indonesia. But, until 2021 there are no further news about how to solve this issue. Justice problems are being suffered by drug addicts and/or drug abuse victims. The main goal of Narcotics Act No. 35/2009 is to rehabilitate drug addicts and or drug abuse victims. But in reality, there are huge number of them that being put into jail forcefully. So, the issue of over-capacity emerges everywhere. North Sumatera is the "champion" of drug cases in Indonesia. Drug dealers are gaining the advantages from the drug addicts and/or drug abuse victims. The way to stop the distribution of drugs in Indonesia is to chase the drug dealers, catch them, and send them to jail along with the charges of criminal law. But, the drug addicts and/or drug abuse victims are receiving negative impacts and being harmful from the drugs itself. So, drug addicts and/or drug abuse victims should be rehabilitated and they can be free from drugs. If drug addicts and/or drug abuse victims are being sent to jail, it will be wasteful and unnecessary because there are also drug dealers in the prison. It is hard to argue that there are a lot of loophole inside every applied laws and acts. But, the existence and observation of law enforcement forces (Indonesian cops, national board of drugs, attorney, and judges) is still useful. They are also being encouraged to use the dignified justice as their foundation in settling the drugs disputes. The goal is to reduce over-capacity in every correctional institution in Indonesia, especially in North Sumatera.
