Abstract
In the case of Mortgage buyer can not appear before a Notary or PPAT, Article
15 of the Law Mortgage provides the opportunity for the assigning of dependents
to use the Power of Attorney Imposing Mortgage (SKMHT). According to Article
1 of the Regulation of the Minister of Agrarian No. 4 of 1994 on Determination
Deadlines SKMHT use to guarantee the repayment of certain loans, the period of
validity SKMHT "until the end of the relevant principal agreement". Related
subsidized loans or small business loans with a credit limit Rp.50.000.000, - (fifty
million rupiah) up to Rp.250.000.000, - (two hundred and fifty million rupiah)
which should each tied with mortgage credit in order in the process of execution
of the object security rights to do Approach to the problem approach the law, with
legal materials consisting of primary legal materials, secondary and non-legal
materials. Analysis of materials research in this thesis using qualitative normative
analysis. In order to draw conclusions from the research that has been collected
is used deductive method of analysis of legal materials. Based on the research we
concluded that, SKMHT this period to be increased to APHT for 1 month to 3
months registered land and for the land has not been registered. This time period
according to Article 15 (5) of the Act Mortgage excluded by Minister of State for
Agrarian Affairs / Head of National Land Agency Number 4 of 1996 concerning
the use of an expiration date SKMHT to guarantee repayment of certain credits.
In the area of mortgages, especially for mortgages subsidized SKMHT time period
is set during the loan period so that the debtor is not burdened with the cost
APHT again. These rules are not in line with the execution of the auction
mortgages arranged by auction house KPKNL (the State Property Office and
Auction) because the main requirement can be done auction security rights that is
the SHT (certificate of encumbrance) in the UUPA. / Dalam hal pembeli Hak Tanggungan tidak dapat hadir di hadapan Notaris
atau PPAT, Pasal 15 Undang-Undang Hak Tanggungan memberikan kesempatan
kepada pemberi hak tanggungan untuk menggunakan Surat Kuasa Membebankan
Hak Tanggungan (SKMHT). Menurut Pasal 1 Peraturan Menteri Agraria Nomor 4
Tahun 1994 Tentang Penetapan Batas Waktu penggunaan SKMHT untuk
menjamin pelunasan kredit tertentu, jangka waktu berlakunya SKMHT “sampai
saat berakhirnya perjanjian pokok yang bersangkutan”. Terkait pemberian kredit
subsidi atau kredit usaha kecil dengan plafon kredit Rp.50.000.000,- (lima puluh
juta rupiah) sampai dengan Rp.250.000.000,- (dua ratus lima puluh juta rupiah)
yang seharusnya setiap kredit diikat dengan hak tanggungan agar dalam proses
eksekusi atas objek hak tanggungan dapat dilakukan
Pendekatan masalah menggunakan pendekatan undang-undang, dengan
bahan hukum yang terdiri dari bahan hukum primer, sekunder dan bahan non
hukum. Analisa bahan penelitian dalam tesis ini menggunakan analisis normatif
kualitatif. Guna menarik kesimpulan dari hasil penelitian yang sudah terkumpul
dipergunakan metode analisa bahan hukum deduktif. Berdasarkan hasil penelitian
diperoleh kesimpulan bahwa, Jangka waktu SKMHT ini untuk ditingkatkan
menjadi APHT selama 1 bulan untuk tanah terdaftar dan 3 bulan untuk tanah
belum terdaftar. Jangka waktu ini menurut Pasal 15 ayat (5) Undang-Undang Hak
Tanggungan dikecualikan berdasarkan Peraturan Menteri Negara Agraria/Kepala
Badan Pertanahan Nasional Nomor 4 Tahun 1996 tentang penetapan batas waktu
penggunaan SKMHT untuk menjamin pelunasan kredit-kredit tertentu. Dalam
bidang KPR, khusus untuk KPR bersubsidi jangka waktu SKMHT ini ditetapkan
selama jangka waktu kredit sehingga debitur tidak dibebani dengan biaya APHT
lagi. Peraturan tersebut tidak sejalan dengan eksekusi lelang hak tanggungan
yang diatur oleh balai lelang KPKNL (Kantor Pelayanan Kekayaan Negara dan
Lelang) karena syarat utama dapat dilakukannya lelang Hak tanggungan yaitu
adanya SHT (sertifikat hak tanggungan) dalam UUPA.
