Abstract

Penerapan kuasa mutlak sering dijumpai dalam bidang hukum Agraria, pemberian kuasa mutlak secara khusus dibatasi dengan adanya Instruksi Menteri Dalam Negeri Nomor 14 Tahun 1982 tentang Larangan Pengunaan Kuasa Mutlak Sebagai Pemindahan Hak Atas dalam perkembangannya menjadi sangat luas, akan tetapi dalam penelitian ini hanya mengkaji mengenai kuasa mutlak dalam Akta Perjanjian Pengikatan Jual Beli (PPJB) & Akta Kuasa Menjual dalam pengalihan hak atas tanah. Metode pendekatan yang dipergunakan dalam penelitian adalah yuridis normatif yang mengkaji data sekunder berupa hukum positif yang berkaitan dengan kuasa mutlak dalam akta PPJB & kuasa menjual. Penelitian ini bersifat deskriptif analitis yaitu menggambarkan permasalahan mengenai kuasa mutlak dalam Akta PPJB & Akta Kuasa Menjual dalam pengalihan hak atas tanah. Dari hasil penelitian ini disimpulkan Akta Kuasa Menjual pada prinsipnya bukan merupakan syarat mutlak dalam pembuatan PPJB karena tanpa adanya Kuasa Menjual, PPJB telah memberikan perlindungan dan kepastian hukum bagi para pihak yang saling mengikatkan diri. Kuasa menjual pada perinsipnya tidak mempunyai kekuatan mengikat karena kuasa menjual bukan merupakan objek pendaftaran tanah dan Akta Kuasa Menjual tidak dapat dijadikan dasar untuk peralihan hak atas tanah dari penjual ke pembeli. Kuasa mutlak yang terdapat dalam akta PPJB hanya bersifat accesoir yang mengikuti perjanjian pokoknya, dimana berarti bahwa pemberian klausula kuasa mutlak tersebut merupakan hal yang tidak dapat terpisahkan dengan perjanjian pokoknya, oleh karenanya pemberian kuasa yang terdapat dalam akta PPJB bukanlah merupakan kuasa mutlak yang dilarang sepanjang tidak bertentangan dengan ketentuan yang termuat dalam Instruksi Menteri Dalam Negeri Nomor 14 Tahun 1982 / The implementation of absolute/ durable power of attorney has been frequently found in Agrarian Law, of which the granting of absolute power of attorney is specifically limited by the Instruction of the Minister of Home Affairs Number 14 Year 1982 on the Prohibition Against the Use of Absolute Power of Attorney in the Transfer of Land Title. The Grant upon Power of Attorney has become wider along this time; however, this research was only aimed to review the Absolute Power of Attorney in the Sale and Purchase Agreement (PPJB) and Power of Attorney to Sell within the transfer of land title. This research used jurisdiction normative as the research method in reviewing the secondary data, which was taking form in positive law in regard with the absolute power of attorney in the deed of Sale and Purchase Agreement and Power of Attorney to Sell. This research was descriptive analysis in nature, of which it would describe the issue relating to the absolute power of attorney in the deed of Sale and Purchase Agreement and the Power of Attorney to Sell within the transfer of land title. From the research result, it could be concluded that the Power of Attorney to Sell, principally, is not the essential requirement in the issuance of Sale and Purchase Agreement, since without the presence of the Power of Attorney to Sell, Sale and Purchase Agreement will have provided a protection and legal assurance to the Parties who bind themselves to each other. In principal, the Power of Attorney to Sell does not have any power to bind one party to another, since the authority to sell is not the object in the land registration and the Power of Attorney to Sell cannot be used as the principle in transferring land title from the seller to the buyer. The Absolute Power of Attorney being put in the deed of Sale and Purchase Agreement is only complementary which will be subject with its underlying agreement, in which it has a meaning that the provision of the absolute power of attorney is the integral part with its underlying agreement, consequently, the power of attorney being put in the deed of Sale and Purchase Agreement will not be deemed as the prohibited absolute power of attorney as long as not in contradiction with the provision being laid out in the Instruction of the Minister of Home Affairs Number 14 Year 1982
