Abstract

Notaris adalah pejabat umum yang berwenang untuk membuat akta otentik dan kewenangan lainnya sebagaimana yang dimaksud dalam Undang-Undang Jabatan Notaris. Notaris wajib menjalankan tugas dan jabatannya sesuai dengan Undang- Undang Jabatan Notaris dan Kode Etik Notaris. Perlindungan hukum kepada pihak ketiga terhadap akta otentik yang telah dibuat oleh Notaris dalam hal akta otentik yang dibuatnya dilakukan dengan itikad tidak baik, maka kepada Notaris dapat dijatuhi sanksi berdasarkan ketentual pasal 85 Undang-Undang No. 30 Tahun 2004 Jo pasal 16 ayat 11 Undang-Undang No.2 Tahun 2014 yaitu berupa teguran lisan, teguran tertulis, pemberhentian sementara, pemberhentian dengan hormat, pemberhentian dengan tidak hormat. Apabila pihak ketiga merasa dirugikan oleh terbitnya akta tersebut, dapat menuntut kerugian kepada Notaris berdasarkan Pasal 1365 KUH Perdata yaitu Tiap perbuatan melanggar hukum yang membawa kerugian kepada seorang lain, mewajibkan orang yang karena salahnya menerbitkan kerugian itu, mengganti kerugian tersebut. Metode penulisan dalam penelitian ini adalah Yuridis Normatif / Notary is a public official who is authorized to make authentic deeds and other authorities referred to in Law Notary. Notary shall perform his duties and in accordance with the Law on Notary and Notary Code. Legal protection to third parties on an authentic deed made by Notary in case he made an authentic deed done in bad faith, then to the Notary can be penalized under the provisions of article 85 of Law No. 30 of 2004 Jo article 16 paragraph 11 of Act No.2 of 2014 in the form of verbal warning, written warning, suspension, dismissal with respect, dishonorable discharge. If the third party feels aggrieved by the issuance of such certificates, may demand damages to the Notary by Article 1365 of the Civil Code which Each unlawful acts that bring harm to another person, require a person who because of his fault publish those losses, to replace those losses.
