Abstract

The easiest way to set a person to default is in an agreement that aims not to commit an act. How to settle defaults in a financing agreement with fiduciary guarantee (PPJF) between PT. ASTRA SEDAYA FINANCE and CV. NEUTRAL ABADI? How to settle defaults in a leasing agreement with option rights between PT. ASTRA SEDAYA FINANCE and CV. NEUTRAL ABADI? How is the suitability of the decision No. 31 / Pdt.G / 2015 / PN.JKT.SEL with the regulations in Indonesia? The form of research used by the author in writing this thesis is normative research. How to settle defaults in a financing agreement with fiduciary guarantees (PPJF) and lease agreements between PT. ASTRA SEDAYA FINANCE and CV. NEUTRAL ABADI is by way of Litigation through a lawsuit to court. Conformity of decision No. 31 / Pdt.G / 2015 / PN.JKT.SEL with the existing regulations in Indonesia, there is a discrepancy in the results of the decision 31 / Pdt.G / 2015 / PN. with Article 34 paragraph (1) of the Fiduciary Guarantee Act. Refraction: 30 (1960-2015). / Paling mudah untuk menetapkan seorang melakukan wanprestasi ialah dalam perjanjian yang bertujuan untuk tidak melakukan suatu perbuatan. Bagaimana cara penyelesaian wanprestasi dalam perjanjian pembiayaan dengan jaminan fidusia (PPJF) antara pihak PT. ASTRA SEDAYA FINANCE dan CV. NETRAL ABADI? Bagaimana cara penyelesaian wanprestasi dalam perjanjian sewa guna usaha dengan hak opsi antara pihak PT. ASTRA SEDAYA FINANCE dan CV. NETRAL ABADI? Bagaimana kesesuaian hasil putusan No. 31/Pdt.G/2015/PN.JKT.SEL dengan peraturan yang ada di Indonesia? Bentuk penelitian yang digunakan penulis dalam penulisan tesis ini adalah penelitian normatif. Cara penyelesaian wanprestasi dalam perjanjian pembiayaan dengan jaminan fidusia (PPJF) dan perjanjian sewa guna usaha antara pihak PT. ASTRA SEDAYA FINANCE dan CV. NETRAL ABADI adalah dengan cara Litigasi melalui gugatan ke pengadilan. Kesesuaian hasil putusan No. 31/Pdt.G/2015/PN.JKT.SEL dengan peraturan yang ada di Indonesia, adanya ketidaksesuaian hasil putusan 31/Pdt.G/2015/PN.JKT.SEL Point 4 dan 5 dengan Undang-Undang Jaminan Fidusia, karena bertentangan dengan Pasal 34 ayat (1) Undang-Undang Jaminan Fidusia.
