Abstract

Tesis ini membahas mengenai peran notaris selaku pejabat umum yang mempunyai kedudukan mandiri dan tidak berpihak sehingga dapat berperan mewujudkan keseimbangan dalam pencantuman klausula-klausula dalam akta notaris.Tesis ini juga membahas mengenai kewajiban notaris untuk mengikuti seluruh ketentuan perundang-undangan yang berlaku dan tidak berpihak. Oleh karena itu notaris dituntut untuk selalu bertindak profesional dan memiliki ilmu pengetahuan di bidang hukum yang cukup dalam menuangkan klausula-klausula dalam akta, dengan berpegang pada Undang-Undang dan asas kepatutan dan asas keseimbangan. Klausula-klausula yang memihak serta bertentangan dengan Undang-Undang dapat mengakibatkan dapat dibatalkannya bahkan batal demi hukum, karena dapat merugikan salah satu pihak atau pihak lain dalam perbuatan hukumnya / This thesis discusses the role of notaries as public officials who have accrued to independent and impartial so as to contribute to achieve balance in the inclusion of clauses in notarial. This thesis also discusses the notary obligation to follow all laws and regulations in force and does not take sides. Therefore, a notary is required to always act professionally and have knowledge in the field of law is sufficient in the pouring clauses in the deed, by adhering to the laws and principles of propriety, principles of good and the principle of balance. Clauses in favor and against the legislation may result in the cancellation can even nul and void, because it can be detrimental to one party or the other party in a legal action
