Abstract

Cover note merupakan surat keterangan yang di buat oleh Notaris, mengenai hal- hal yang belum lengkap, terkait dengan proses pembuatan akta yang dilakukan di hadapan Notaris. Secara hukum, cover note bukanlah akta otentik yang menjadi tugas dan kewenangan Notaris yang tercantum di dalam UUJN, sehingga kekuatan pembuktiannya hanya sebagai surat di bawah tangan. Meskipun demikian, Pasal 1338 KUHPerdata menyebutkan bahwa suatu perjanjian menjadi Undang-Undang bagi para pihak yang membuatnya, termasuk di dalamnya surat di bawah tangan, apabila isi dari surat atau dokumen di taati oleh kedua belah pihak dan keduanya memiliki itikad baik untuk menjalankan isi dari surat dibawah tangan tersebut. Permasalahannya adalah, ketika cover note hanya di pergunakan sebagai hiasan, terutama dalam proses pelaksanaan jual beli tanah antara developer dengan pembeli, dimana developer tidak menjalankan kewajibannya dalam cover note, atau ketika proses penerbitan sertipikat hak atas tanah bermasalah di BPN, di perlukan penegasan tentang sejauh mana tanggungjawab Notaris. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan Perundang-undangan dan juga pendekatan kasus, yaitu dengan menganalisa peraturan perundangan terkait pertanggungjawaban Notaris sebagai pembuat cover note dalam pelanggaran yang dilakukan developer dan BPN dalam penerbitan sertipikat. Penelitian ini menggunakan metode yurids normative yang memusatkan penelitian terutama pada studi kepustakaan. Menggunakan teori tanggungjawab hukum milik Hans Kelsen dapat disimpulkan bahwa tanggungjawab Notaris berdasarkan ketentuan UUJN adalah terhadap akta yang dibuat oleh atau dihadapannya. Berdasarkan uraian tersebut maka penelitian di hasilkan gambaran bahwa ketika Notaris terbukti dengan sengaja bekerjasama dengan developer tidak melaksanakan ketentuan sebagaimana yang di perjanjikan didalam cover note maka Notaris yang bersangkutan dapat di pertanggungjawabkan mengganti kerugian, biaya, dan bunga. Dalam hal BPN tidak menjalankan proses penerbitan sertipikat sesuai dengan perjanjian didalam cover note, maka tidak dapatlah Notaris di pertanggung jawabkan apabila ia dapat membuktikan bahwa kelalaian tidak berasal dari Notaris / Cover note is a statement made by a Notary, on uncomplete matters, is associated with the deed done before Notary. By law, the cover note is not authentic act that consist the duties and authority stated in the Notary by UUJN, so that the strength of proof only as a note under her hands. Nevertheless, Article 1338 of the Civil Code states that an agreement be the law for the parties who made it, including a note under hand, if the content of the letter or document adhered to by both parties and both have good faith to execute the contents of the letter under the hand. The problem is, when the cover note is only used as a garnish, especially in the implementation process of buying and selling of land between the developer with the buyer, where the developer does not perform its obligations under the cover note, or when the process of issuing land rights certificates troubled BPN, confirmation of the extent is required of the responsibility of the Notary. In this study, data collection is done by using the statue approach and case approach i.e. by analyzing the related regulations related to the Notary accountability as the maker of cover note in offenses committed developer and BPN in the issuance of certificates. This study uses yuridis normative research focusing primarily on the study of literature. Using the theory of Hans Kelsen's legal responsibility, that legal responsibility can be concluded that under the provisions UUJN Notary responsibility is to deed made by or before him. From this research we could take a good picture about, When Notary proved to deliberately collaborated with the developer does not implement the provisions as agreed upon in the cover note, the Notary in question can be accounted replace losses, costs, and interest. In the case of BPN not execute the process of issuing a certificate in accordance with the agreement in the cover note, then it can be a notary in accountable if he can prove that the omission does not come from the Notary
