Daily human activities cannot be separated from the functions and benefits of land that can occur today. Therefore, land issues are a major problem in survival, land problems for humans are endless because they have a very important meaning in human life and life. There are also many problems regarding land disputes at this time. One of them is the case that the author will raise, namely from the decision number 38 /Pdt.G/2019/PN Sel. This study the authors use normative legal research by taking data from library materials and secondary data. In this matter the main problem was that the Defendant committed an illegal act because he took people's land without permission. Actions against the law are defined as any actions that are contrary to the rights of others that arise because of the law (onwetmatig). In this research, the Defendants were proven to have committed an illegal act because they had fulfilled all the elements. From a civil law perspective, if the owner of the house feels that he is being harmed by the act of occupying the house, the owner of the house can file a civil suit to the district court on the basis of an illegal act (PMH). In this case the Plaintiff, through his lawsuit, sued the Defendants on the basis of Civil Law which was included in Acts against the Law.
