Abstract
Dalam proses sekuritisasi KPR, piutang KPR dan beserta dengan Hak Tanggungan yang melekat padanya dijual oleh bank secara cessie kepada Perusahaan Pembiayaan Sekunder Perumahan melalui mekanisme perjanjian Kredit Investasi Kolektif Efek Beragun Aset (KIK-EBA).Perusahaan Pembiayaan Sekunder Perumahan selanjutnya menjual piutang KPR beserta Hak Tanggungan tersebut kepada investor dalam bentuk saham, obligasi, atau surat berharga jangka pendek.
Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan Undang-Undang (statute approach) dan pendekatan konseptual (conceptual approach), yaitu dengan mewawancarai langsung kepada pihak-pihak yang terlibat langsung dalam proses sekuritisasi KPR. Dari hasil penelitian tersebut dapat disimpulkan bahwa kendala dalam UUHT yang tidak dikenalnya penjualan tagihan berikut Hak Tanggungan yang melekat padanya dalam jumlah yang besar dimana balik nama pemegang Hak Tanggungan dicatat satu persatu sehingga proses pencatatan tersebut menjadi kendala besar dalam efisiensi waktu dan biaya. / In the process of KPR securitization, KPR credit and mortgage rights along with it are sold by bank in cessie to Secondary Housing Finance Company through agreement mechanism of Investment Loan Asset Backed Securities Collective (KIK-EBA). The Secondary Housing Finance Company subsequently sell KPR credit and its mortgage rights to investor in the form of stock bond, or short-term securities.
In this study, data collection is done by using the approach of Act (statute approach) and the conceptual approach, namely by interviewing directly to the parties that involved in the process of KPR securitization. As results, the obstacles in UUHT that unfamiliar with sales bill and its Mortgage Rights with large amount behind the name of the mortgage rights holder in which recorded one by one so that the recording process is a major obstacle especially time and cost efficiency
