Abstract

Dalam rangka meningkatkan taraf hidup serta kesejahteraan masyarakat Indonesia, maka diperlukan pembangunan nasional yang berorientasi pada pembangunan ekonomi yang berkesinambungan. Salah satu upaya meningkatkan kesejahteraan ekonomi masyarakat Indonesia, adalah upaya pemerintah dalam membantu menyediakan lembaga keuangan sebagai lembaga yang dapat memberikan pinjaman dana dan penjamin bagi masyarakat jika akan menguasai suatu hak atas tanah atau property. Perihal hak penguasaan atas tanah diatur dalam Pasal 4, Undang-undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok- Pokok Agraria atau yang selanjutnya akan disebut UUPA dan Undang-Undang Nomor 4 Tahun 1996 Tentang Hak Tanggungan Atas Tanah Beserta Benda- Benda Yang Berkaitan Dengan Tanah. Apabila masyarakat melibatkan lembaga keuangan sebagai sumber pembiayaan dan penjamin, maka menjadi suatu prosedur bahwa akan timbul jenis penguasaan hak atas tanah dengan menerbitkan sertifikat Hak Tanggungan. Prosedur penerbitan sertifikat Hak Tanggungan didahului dengan pendaftaran Hak Tanggungan di Kantor Pertanahan setempat, yang akan dilakukan oleh PPAT. Dengan adanya prosedur pendaftaran Hak Tanggungan dengan ketentuan jangka waktu sesuai UUHT, maka diharapkan akan memberikan kepastian serta perlindungan hukum bagi kreditur. Namun dalam prakteknya dapat terjadi keterlambatan atas pendaftaran Hak Tanggungan tersebut, dan dikuatirkan terdapat kekosongan hak dalam masa sebelum didaftarkannya APHT sehingga akan membuat hak kreditur preferen menjadi hilang. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan perundang-undangan, yaitu pendekatan yang dilakukan terhadap berbagai aturan hukum mengenai pendaftaran Hak Tanggungan dan akibat hukum jika terjadi keterlambatan / In order to improve human life and public welfare, it is necessary to national development oriented on sustainable economic development. One effort to improve the economic welfare of the people of Indonesia is the Government’s effort in helping to provide financial institution as an institution that can provide loans and guarantor of public funds to master a land rights or property. Provision of land rights set in Article 4 of Law No. 5 of 1960 on the Regulation of Agrarian Policy (UUPA) and the Act No. 4 of 1996 about Mortgage of Land and Other Bodies related to Land (UUHT). If society involves financial institution as a source of financing and guarantor, then it becomes a mandatory procedure that will arise kinds of land property by issuing Mortgage Certificates. Mortgage Certificate issuance procedure is preceded by registration of mortgage in the local land office which will be performed by PPAT. With the procedure of registration of motgage appropriate with the provisions period UUHT, it is hoped will provide certainty and legal protection for creditors. But in practice it may be a delay on the registration of mortgage and worried that there is a vacancy within its rights before the registration of APHT so it is feared will make the rights of preferred creditor becomes lost. In this research, data collection is done by using regulation approach that is the approach taken to various law on the registration of mortgage and legal consequences in case of delays
