Hak atas tanah pada dasarnya adalah sebuah kewenangan untuk memakai sebidang tanah tertentu dengan mengusahakan atau memakai sebagai tempat membangun sesuatu. Apabila kondisi tanah yang telah diberi hak atas tanah ditelantarkan oleh pemilik tanah maka hak atas tanah tersebut dapat hapus dan tanah kembali dikuasai oleh negara, sebagaimana diatur dalam Undang-Undang Pokok Agraria. Namun akan terjadi permasalahan hukum apabila penyebab tanah ditelantarkan bukanlah kesalahan atau kelalaian dari pemegang hak dan prosedur penetapan tanah terlantar tersebut tidak sesuai dengan peraturan perundang-undangan. Untuk itu diperlukan penelitian mengenai: (i) kesesuaian suatu penetapan tanah terlantar dengan peraturan perundang-undangan yang berlaku dan (ii) bagaimana kekuatan hukum surat keputusan penetapan tanah terlantar tersebut dalam hal dibatalkan oleh putusan Pengadilan Tata Usaha Negara. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan undang-undang dan pendekatan kasus. Jenis penelitan yang digunakan penulis dalam menulis tesis ini adalah penelitian hukum normatif. Alasan penulis menggunakan penelitian hukum normatif adalah agar dapat menghasilkan suatu pemikiran baru, yang dapat dipergunakan untuk menjawab permasalahan hukum yang diangkat dalam tesis ini. Penulis menyimpulkan bahwa: (i) apabila penyebab tanah ditetapkan sebagai tanah terlantar bukan merupakan kelalaian maupun kesalahan dari pemilik tanah dan prosedur penetapannya tidak sesuai dengan ketentuan dalam peraturan perundang-undangan yang berlaku, maka penerbitan surat keputusan penetapan tanah terlantar atas tersebut bertentangan dengan peraturan perundang-undangan, dan (ii) dalam hal keputusan penetapan tanah terlantar oleh Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional dibatalkan oleh putusan Pengadilan Negeri Tata Usaha Negara yang berkekuatan tetap maka kekuatan hukum surat keputusan tanah terlantar tersebut menjadi hilang / In principle, land title is an authority to use a certain plot of land by cultivating or using as a place to build something. In event of the condition of the land is abandoned by the land owner then the title of such land may be revoked and the land will be owned by the state, as regulated under the Basic Agrarian Law. However there will be some legal issues if the cause of the abandoned land is not due to any default or omission by the land rights holder and the procedure of determining the abandoned land is not in accordance with the prevailing laws and regulations. As such, it is required to conduct a research regarding: (i) the conformity of a decision of abandoned land to the prevailing laws and regulations and (ii) how is the legal force of such decree of abandoned land which has been annulled by a State Administrative Court decision. In this research, the collection of data is conducted using the law approach and case approach. The type of research used by the writer in writing this thesis is the normative legal research. The reason why the writer use the normative legal research is to create a new consideration, which can be used to answer the legal issue raised in this thesis. The writer concluded that: (i) if the cause of which the land is declared as an abandoned land was not due to negligence or fault by the land owner and the procedure of determining such abandoned land was not in accordance with the provisions under the prevailing laws, thus the issuance of the abandoned land decree is contrary to the laws and regulations, and(ii) in the case of the decree of abandoned land by Minister of Agrarian Affairs and Spatial/Head of National Land Agency has been annulled by the decision of a State Administrative Court then the legal force of such abandoned land decree shall be removed
