Abstract

Seluruh Notaris di Indonesia sepatutnya tunduk pada Pelaksanaan Kode Etik dan Undang-Undang Jabatan Notaris, terutama dalam hal kewenangan wilayah jabatan seluruh wilayah provinsi yang telah diatur dalam pasal 19 ayat (1) UUJN. Penelitian ini bertujuan untuk mengetahui penerapan Kode Etik dan Undang-Undang Jabatan Notaris terhadap larangan pembuatan akta otentik Notaris di luar wilayah jabatan dan bagaimana sanksi hukum yang berlaku terhadap Notaris yang melanggar. Kesimpulan yang didapat adalah pelanggaran yang dilakukan oleh Notaris yang tidak bekerja sesuai dengan wilayah kerjanya dapat di berikan sanksi berupa teguran lisan, skorsing bahkan diberhentikan secara tidak hormat oleh Dewan Kehormatan hal tersebut tertuang pada pasal 17 ayat (2) UUJN / All notaries in Indonesia shall respect and obey the implementation of the ethic codes and the constitution of notary function, mainly in respecting the working area authority in the whole province that has been regulated under the article 19 paragraph 1 of the constitution. This research aims to discover the implementation of the ethic codes and the constitution of notary function, in regard to the prohibition of authentic notary act production outside the working area and the legal sanctions to the convicted notary. This research has discovered that violations conducted by notary who do not work in accordance with the official working area shall be sanctioned. The sanctions could be verbal warning, suspensions and even disrespectfully dismissed from the job. These are regulated under article 17 paragraph 2 of the constitution
