Abstract

Indonesia is a state law, so that Indonesia adhere to principle of legal trust. The number of problem that occur especially the problem about euthanasia make Indonesia have to use a regulation that refers to the act of euthanasia. Every issue about euthanasia is always associated with the criminal code, considering that Indonesia prohibits the act of euthanasia because it contradict to the Pancasila and Constitution of the Republic of Indonesia 1945. This research was conducted in several regions, namely RSUD Kotamobagu, RSUD Bogor, Mitra Keluarga Hospital Kalideres and Johannes Oentoro Library Pelita Harapan University. The research method that the author uses to achieve the objectives of the author is a qualitative normative method through library research and interviews, where the data is taken from the purposive sampling method. The results of this research indicate that until now Indonesia has never legalized or given permission to the public and medical personnel to carry out euthanasia even though these patients did not appear to be recovering. Not only is the act of active euthanasia prohibited, it is also passively prohibited by Indonesia even though there are no regulations that explicitly and clearly prohibit this. If there is an act of passive euthanasia, the party doing this must be sanctioned, but sanctions for those who carry out euthanasia passively there is no positive law governing this action, because based on Article 344 of the Criminal Code is not very relevant to passive euthanasia especially in the case of the doctor who told the patient to go home even though the patient had not recovered medically
