Abstract

Pendaftaran tanah merupakan upaya yang diadakan oleh pemerintah yang bertujuan untuk menjamin kepastian hukum hak atas tanah, sebagaimana diamanatkan oleh Pasal 19 ayat (1) Undang-undang Pokok Agraria. Pendaftaran tanah akan menghasilkan kepastian bukti hak atas tanah sebagai dasar status kepemilikan tanah yang disebut sertipikat. Pendaftaran tanah yang sudah cukup lama diadakan, ternyata belum cukup memberikan hasil yang memuaskan. Ada beberapa hal yang menjadi kendala dalam pelaksanaan pendaftaran tanah atau faktor-faktor yang menyebabkan tidak tercapainya pendaftaran tanah terhadap jaminan kepastian hukum di antaranya adalah: ketentuan hukumnya sendiri yang kurang memberikan kemungkinan untuk melaksanakan pendaftaran tanah dalam waktu yang singkat, juga mahalnya biaya pendaftaran tanah sehingga tidak terjangkau oleh golongan ekonomi lemah. Untuk mengatasi kendala-kendala atau faktor-faktor tersebut, BPN telah melakukan upaya-upaya konkrit, yaitu dengan merealisasikan beberapa programnya, di antaranya adalah Prona dan ajudikasi.Dengan demikian, sertipikat hak atas tanah yang ditandatangani bukan oleh Kepala Kantor Pertanahan dalam pendaftaran tanah memberikan jaminan kepastian hukum hak atas tanah / Land registration is an effort made by the government that aims to ensure legal certainty of land rights, as mandated by Article 19 Paragraph (1) of the Basic Agrarian Law. Land registration will result in the assurance of land title as the basis of land ownership status called a certificate. Land registration that has been held long enough, was not enough to provide satisfactory results. There are a number of obstacles in the implementation of land registration or the factors that prevent land registration from being guaranteed legal certainty, among others: the legal provisions themselves are less likely to carry out land registration in a short time, as well as the high cost of land registration so that Not reachable by the weak economic class. To overcome these constraints or factors, BPN has made concrete efforts, namely by realizing several programs, among them are Prona and adjudication. Thus, a land title certificate which is not by the Head of Land Office in land registration provides a signed guarantee on legal certainty of land rights
