Abstract

Land is an important factor in people's lives and natural resources that are very needed by humans to meet their needs, both for housing and business, such as for trade, industry, construction of facilities and other infrastructure. Therefore, the land system in Indonesia has been regulated in Law No. 5 of 1960 concerning Basic Agrarian Principles Regulation (UUPA). The development of land in Indonesia is accompanied by various economic, social, and political interests. Along with the development of the times, land issues related to the implementation of Law No. 5 of 1960 (UUPA) is increasingly complex. This is because the land must continue to increase with very limited land availability. Therefore, it is not surprising if this cause land disputes. In addition to this, one of the land disputes that have often occurred in people's lives is the problem of overlapping land certificates. Basically, the lack of adequate capacity is very easy to trigger this problem. The parties that have the authority to regulate land registration are often found negligent in carrying out their duties. So that many parties feel disadvantaged. On the other hand, there have been many buyers who have good intentions but the land they have purchased is apparently the land that is being disputed. Recognizing that many land certificate disputes overlap, then directly or indirectly must always be directed at the implementation of legal order by guaranteeing legal certainty and legal protection. With many cases of buyers having good intentions found, this should trigger the government to assert legal protection. In general, legal protection has become the right of every citizen. Therefore, the state must provide legal protection to its citizens.
