Abstract

Pengadaan Tanah untuk kepentingan umum. Dalam pembangunan atau proses pengadaan tanah yang menjadi obyek tidak hanya orang perorangan tapi badan hukum baik pemerintah maupun Badan Usaha Milik Negara, untuk proses pengadaan tanah diatas milik Badan Usaha Milik Negara dalam hal ini PT Kereta Api Indonesia maka terdapat aturan Peraturan Menteri Badan usaha Milik negara yang mengatur tentang tata cara pemindahtanganan atau penghapusbukuan aktifa tetap Badan Usaha Milik Negara. Dalam aturan ini menyatakan bahwa direksi diberikan kewenangan untuk proses pemindahtanganan dengan atas persetujuan Menteri Badan usaha Milik Negara atas tanah yang menjadi obyek Pengadaan tanah Milik Badan usaha Milik Negara. Namun meskipun ada aturan mengenai Permen tetap Undang-undang No 2 harus diperhatikan dan dalam jangka waktu 30 ( Tiga Puluh ) hari tanah tersebut menjadi tanah negara. Hal ini dikarenakan bahwa secara Hirarki Perundang-undangan Undang-undang lebih tinggi dibandingkan dengan Peraturan Menteri. Sehingga dalam pelaksanaanya pihak yang menjadi obyek dari Pengadaan Tanah harus tunduk kepada Peraturan Undang-undang No 2 Tahun 2012. Selain itu juga bahwa pengadaan tanah sangat berdampak bagi lingkungan, ekonomi dan sosial atas proses pengadaan tanah tersebut / Land is a much needed natural resource for humans including the state in terms of infrastructure development requiring land, but the soil is getting worse so that the land itself is very difficult to obtain therefore the State as the supreme authority to govern the land. In the case of land acquisition for public interest such as toll road, highway and railway development in this case intent and purpose only for public interest. Therefore the government issued Law No. 2 of 2012 on Land Procurement for the public interest. In the construction or the process of land acquisition that becomes the object not only individuals but legal entities both government and State Owned Enterprises, for the process of land procurement above owned by State-Owned Enterprises in this case PT Kereta Api Indonesia there is a regulation of Minister of State-Owned Enterprises Which regulates the procedure for the alienation or write-off of fixed assets of State-Owned Enterprises. In this rule states that the directors are given authority for the process of alienation with the approval of the Minister of State-Owned Enterprises on the land being the object of procurement of land owned by a State- Owned Enterprise. However, even if there is a regulation concerning Permen still Law No. 2 must be considered and within 30 (Thirty) days the land becomes state land. This is because the Hierarchy of Legislation Law is higher than the Ministerial Regulation. So in the implementation of the parties who become the object of Land Procurement must be subject to Regulation No. 2 of 2012. In addition also that the procurement of land greatly affect the environment, economic and social on the procurement process of the land
