Criminal Provisions An act is called an act if it is violated by administrative law. An action is called Unlawful Action if a violation of criminal law, the threat of criminal law is imposed for its actions, not on its person, while the person is punished for committing criminal acts. in Indonesia there seems to be no end. This study uses the Normative Juridical research method based on the Law and case studies studied, because in this study the main subject of discussion is how the criminal provisions for flats are given HGB status above the Provincial Government's HPL and discuss the relevant regulatory regulations regarding the legal actions of the parties developers with the government who do not notify the agreement of the two parties so as a result it creates bad faith that harms the consumer. so that after this study the authors concluded that the developer and the Jakarta provincial government,because Law no. 5 of 1960 on Basic Agrarian Regulations and Law No. 12 of 2011 on Estabilishment of Regulations, it’s violated agrarian criminal provisions and also did not have good intentions because they did not first to consumers regarding the status of the land so that later a dispute arises that harms consumers in terms of the extension of the HGB permits.
