Abstract
Sertifikat ganda adalah sertifikat-sertifikat yang menguraikan suatu bidang tanah yang sama baik itu tumpang tindih sebagian, maupun tumpang tindih seluruhnya. Apabila terjadi maka salah satunya haruslah dibatalkan. Sertifikat ganda juga terjadi di Kota Samarinda, hal ini bisa dilihat dari putusan Mahkamah Agung Nomor 562K/TUN/2014. Permasalahan dalam thesis ini dianalisa menggunakan metode penelitian normatif dan ada 4 masalah yaitu analisa terhadap putusan di atas, penyebab timbulnya sertifikat ganda, bagaimana kepastian hukum atas sertifikat ganda, dan bagaimana perlindungan hukum terhadap pihak yang dirugikan akibat pembatalan sertifikat. Faktor-Faktor Terbitnya sertifikat ganda diakibatkan karena tidak cermat dan teliti dalam melakukan verifikasi tanah yang berakibat pada cacatnya administrasi dalam pengolahan data pertanahan, belum tersedianya peta dasar pendaftaran, dan disertifikasi tidak sesuai dengan ketentuan hukum yang ada, sehingga sertifikat yang terbit tidak sesuai dengan kondisi tanah yang sebenarnya, hal ini berdampak pada munculnya sengketa kepemilikan tanah. Sertifikat dipandang memiliki pembuktian yang kuat, selama tidak dibuktikan sebaliknya karena Indonesia menganut sistem publikasi negatif, jadi perlindungan hukum bagi pihak yang dirugikan adalah sejatinya diberikan kepada orang yang paling berhak atas tanah tersebut / Overlapping certificates are certificates that describe an equal plot of land either partially overlapping, or completely overlapping. If it happens then one of them should be canceled. Overlapping certificates also occur in Samarinda City, this can be seen from the Supreme Court decision Number 562K / TUN / 2014. The problems in this thesis analyze with normative method and had 4 problems, that is the analysis of the Supreme Court decision above, the cause of the overlapping certificate, how the legal certainty of the overlapping certificate, and how the legal protection against the disadvantaged party to the cancellation of the certificate. Factors issued by the overlapping certificate resulted from inadequate and meticulous in conducting land verification resulting in administrative defects in processing of land data, unavailability of registration base map, and certified not in accordance with existing legal provisions, so that the published certificate is not in accordance with the conditions The real land, this has an impact on the emergence of land ownership disputes. The certificate is deemed to have strong proof, as long as it is not proved otherwise because Indonesia embraces a negative publication system, so the legal protection for the injured party is actually given to the person most entitled to the land.
