Abstract

Perjanjian Pengikatan Jual Beli (PPJB) adalah perjanjian dimana para pihak bersedia mengikatkan diri dan berjanji untuk melakukan jual beli. Suatu Perjanjian Pengikatan Jual Beli (PPJB) yang digunakan dalam penjualan satuan unit rumah susun bertentangan dengan peraturan perundang-undangan yang berlaku. Tujuan penelitian ini adalah untuk mengetahui prosedur jual beli atas satuan rumah susun apakah sesuai dengan peraturan perundang-undangan yang berlaku dan tanggung jawab pengembang dalam Pelaksanaan Perjanjian Pengikatan Jual Beli (PPJB) yang mengandung unsur perbuatan melawan hukum ditinjau dari Putusan Nomor 089/Pdt.G/2013/PN.JKT.BAR. Penelitian ini dilakukan melalui metode normatif dengan menggunakan data. sekunder yang dianalisis secara kualitatif dan ditunjang dengan wawancara. Hasil penelitian menunjukkan bahwa pihak pengembang telah melakukan perbuatan melawan hukum dengan menjaminkan surat-surat atau dokumen kepemilikan atas satuan rumah susun seperti sertifikat, akta jual beli, dan dokumen-dokumen lainnya kepada PT. Bank Muamalat Indonesia, Tbk dikarenakan pihak pengembang mempunyai kredit macet dengan pihak bank tersebut. Selain itu juga pihak pengembang mempunyai hutang dengan pihak ketiga dan ahli waris Radja Bin Brong. Prosedur Jual Beli yang telah dilaksanakan tidak sesuai dengan peraturan perundang-undangan yang berlaku. Oleh karena itu pihak pengembang harus membayar ganti rugi sebagai bentuk dari tanggung jawabnya / Preliminary Sale and Purchase is an agreement whereby the parties are willing to bind themselves and promise to make a sale. Marketing in the form of PPJB used in the sale of units of apartment units is contrary to the prevailing laws and regulations. The purpose of this study is to determine the procedure of buying and . selling of apartment units whether in accordance with applicable laws and regulations and the responsibility of developers in the Implementation of the Sale and Purchase Agreement which contains elements of unlawful act in terms of Decision Number 089 / Pdt.G / 2013 / PN.JKT.BAR. This research is done through normative method by using secondary data which analyzed gualitatively and supported by interview. The results show that the developer has committed against the law by pledging letters or ownership documents of apartment units such as certificates, deeds of sale and other documents to PT. Bank Muamalat Indonesia, Tbk due to the developer has bad credit with the bank. In addition, the developers have debt with third parties and heirs Radja Bin Brong. Procedures Sale and Purchase that has been implemented is not in accordance with applicable legislation. Therefore the developer must pay compensation as a form of responsibility
