Abstract

Hakim dalam memutus suatu perkara harus berdasarkan alat bukti yang sah. Salah satu bukti yang sah adalah akta autentik dan Notaris adalah pejabat umum yang berwenang membuat akta autentik. Akta Notaris memiliki kekuatan pembuktian formil dan materiil, namun apabila akta Notaris mengandung cacat secara materialdan telah dinyatakan batal oleh Pengadilan, maka permasalahan dalam penelitian ini adalah bagaimana kewenangan Pengadilan dalam membatalkan suatu akta yang dibuat oleh Notaris dan bagaimanaakibat hukum bagi Notaris yang aktanya dibatalkan oleh Pengadilan.Metode penelitian dalam penelitian ini adalah yuridis normatif. Kasus dalam penulisan ini bermula dari Akta Pengakuan Hutang dan Kuasa Menjual yang dibuat dihadapan Notaris dibatalkan oleh Putusan Pengadilan Negeri Jakarta Pusat Nomor 301/Pdt.G/2012/PN.JKT.PST karena objek dari dibuatnya Akta Pengakuan Hutang dan Kuasa Menjual tersebut tidak ada, sehingga melanggar syarat objektif dari syarat sahnya perjanjian, konsekuensi dari tidak terpenuhinya syarat objektif tersebut akta Notaris batal demi hukum. Hasil penelitian ini adalah Pengadilan berwenang membatalkan akta Notaris dalam kasus tersebut karena dalam telah berpedoman kepada Undang- Undang.Akibat hukum bagi notaris tergantung dari pelanggaran yang dilakukan Notaris tergantung dari ada atau tidaknya kelalaian yang dilakukan oleh Notaris dalam pembuatan akta / The judge in deciding a case must be based on valid evidence. One of the legitimate proofs is an authentic deed and a Notary is a public official authorized to create an authentic deed. Notarial deeds possess formal and material proof power, but if the deed of Notary contains material defects and has been declared null and void by the Court, then the problem in this research is how the authority of the Court in canceling a deed made by Notary and how the legal effect for Notary whose the deed has been canceled By the Court. Research method in this research is normative juridical. The case in this writing stems from the Deed of Recognition of Payables and the Power of Selling made before the Notary is annulled by the Central Jakarta District Court with Decision Number 301 / Pdt.G / 2012 / PN.JKT.PST because the object of the deed of recognition of debt and the power of such sale is void, in violation of the objective terms of the validity of the agreement, the consequence of the non-fulfillment of the objective requirement of the Notarial Deed is null and void. The result of this research is that the Court has the authority to cancel the Notary Deed in such case because it has been guided by the Law. The legal consequences for a notary depend on the violation made by a Notary, depending on whether or not the omission made by a Notary in the deed is made
