Abstract

Perjanjian Perkawinan adalah suatu perjanjian yang dibuat sebelum perkawinan dilangsungkan dan mengikat kedua belah pihak calon pengantin yang akan menikah dan berlaku selama pernikahan dilangsungkan. Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 memberikan perubahan dalam pengaturan mengenai perjanjian kawin, dimana perjanjian kawin yang semula hanya dapat dibuat oleh calon suami istri sebelum perkawinan, sekarang dapat dibuat oleh suami istri setelah perkawinan berlangsung. Penelitian ini bertujuan untuk mengetahui dampak perjanjian kawin pasca Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 terhadap pihak ketiga. Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan Undang-Undang dan Pendekatan Kasus. Data yang digunakan adalah data sekunder yang berupa bahan hukum primer, sekunder dan tersier. Hasil penelitian menunjukkan bahwa penetapan pengadilan pasca Putusan Mahkamah Konstitusi Nomor 69/PUU- XIII/2015 sudah tidak lagi diperlukan hal ini dikarenakan Putusan Mahkamah Konstitusi memiliki kekuatan hukum yang lebih kuat daripada Penetapan Pengadilan. Sedangkan dampak perjanjian kawin terhadap pihak ketiga pasca Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 yaitu perjanjian kawin mengikat pihak ketiga apabila perjanjian kawin tersebut telah memenuhi asas publisitas yaitu di daftarkan ke Kantor Urusan Agama (KUA) atau Kantor Catatan Sipil / Marriage/Prenuptial Agreement is an agreement made before the marriage and binds the couples who want to marry and applies as long as the marriage. The Constitutional Court Decision Number 69/PUU-XIII/2015 makes several changes in the regulation of marriage/prenuptial agreement, in which the agreement can be made by the couples during the marriage which initially is only allowed to be made before the marriage. The purpose of this study is to find out the effect of marriage/prenuptial agreement on the third party after the Constitutional Court Decision Number 69/PUU-XIII/2015. It is a normative study with approaches to the Law and Cases. The data used in this study are secondary data in the form of primary, secondary, and tertiary legal materials. The results of the study showed that the Court Order/Penetapan Pengadilan after the Constitutional Court Decision Number 69/PUU-XIII/2015 is no longer required since the Constitutional Court Decision has a stronger legal power than the Court Order/Penetapan Pengadilan. Meanwhile, the effect of marriage/prenuptial agreement on the third party after the Constitutional Court Decision Number 69/PUU-XIII/2015 is that the agreement binds the third party if it has met the principles of the publicity, which is it has been registered to the Office of Religious Affairs/Kantor Urusan Agama (KUA) or to the Civil Registry Office/Kantor Catatan Sipil
