Abstract

Notaris adalah pejabat umum yang berwenang untuk membuat akta autentik dan memiliki kewenangan lainnya sebagaimana dimaksud dalam Undang-Undang Jabatan Notaris atau berdasarkan undang-undang lainnya. Notaris juga memiliki kewajiban untuk melayani masyarakat. Kewajiban yang harus diemban Notaris sebagai pejabat umum selain terdapat dalam Pasal 16 ayat (1) UUJN, juga terdapat dalam Pasal 37 ayat (1) UUJN dan juga Pasal 3 ayat (7) Kode Etik Notaris Ikatan Notaris Indonesia. Kewajiban yang dimaksud adalah tanggung jawab sosial Notaris untuk memberikan jasa hukum di bidang kenotariatan secara cuma-cuma kepada orang yang tidak mampu. Penulis bermaksud melakukan penelitian atas tanggung jawab sosial Notaris berkaitan dengan Pasal 37 ayat (1) UUJN terhadap masyarakat yang tidak mampu. Hal ini bertujuan untuk mengetahui realisasi pelaksanaan Pasal 37 ayat (1) UUJN, akibat hukum bagi Notaris yang tidak melaksanakan Pasal 37 ayat (1) UUJN, dan juga untuk mengetahui peran Organisasi Profesi Notaris terhadap Notaris yang melanggar Pasal 37 ayat (1) UUJN. Metode yang penulis gunakan dalam penelitian ini adalah penelitian hukum normatif karena penelitian ini dilakukan dengan cara menelaah data-data sekunder. Penelitian normatif ini termasuk penelitian hukum kepustakaan, yaitu penelitian yang mengkaji berbagai aturan hukum yang bersifat formil. Penulis juga menggunakan bahan hukum primer sebagai pendukung atas UUJN dan Kode Etik Notaris. Berdasarkan hasil penelitian ini, penulis menyimpulkan bahwa realisasi pelaksanaan tanggung jawab sosial Notaris untuk memberikan jasa hukum di bidang kenotariatan secara cuma-cuma kepada orang yang tidak mampu sebagaimana dimaksud dalam Pasal 37 ayat (1) Undang-Undang Jabatan Notaris belum terlaksana dengan baik. Akibat hukum bagi Notaris yang tidak melaksanakan Pasal 37 ayat (1) Undang-Undang Jabatan Notaris dapat dikenakan sanksi. Sanksi sesuai Pasal 37 ayat (2) Undang-Undang Jabatan Notaris adalah peringatan lisan, peringatan tertulis, pemberhentian sementara, pemberhentian dengan hormat, atau pemberhentian dengan tidak hormat. Sanksi sesuai Kode Etik Notaris adalah teguran, peringatan, schorsing (pemecatan sementara) dari keanggotaan Perkumpulan, onzetting (pemecatan) dari keanggotaan Perkumpulan, dan pemberhentian dengan tidak hormat dari keanggotaan Perkumpulan. Majelis Pengawas Daerah bukan merupakan bagian dari organisasi profesi Notaris karena dibentuk oleh Menteri sesuai dengan Pasal 67 ayat (2) UUJN / Notary is public official who authorized to make authentic certificate and has the others authority as referred to in law office of the notary or based on the other law. Notary also has an obligation to serve the community. Obligation to hold as a notary as the officials public besides found in article 16 verse (1) Law in Office of the Notary , it is also present in article 37 paragraph (1) and also article 3 paragraph (7) ethic code of notary bonding of Indonesia Notary. Obligation referred to are social responsibility of notary to give legal service in the field of office of notary freely to those who are not capable. Writer set out to do research over social responsibility of notary pertaining to article 37 paragraph (1) Law in Office of the Notary to those who are not capable. It is meant to know the realization the implementation of article 37 paragraph (1) Law in Office of the Notary, due to legal for notary who do not confidence article 37 paragraph (1), and also determine the role of organization of notary proffesion to the notary who violated article 37 paragraph (1) Law in Office of the Notary. Method that writer use in this research is normative law research because this research is done by review secondary material. This normative research is including research of law literature, which is research with looked at various the rule of law that are formil .The writer also use a primary law as a supporter of Law in Office of the Notary and Ethic Code of Notary . Based on the results of this research, the writer concluded that the realisation of the implementation of Article 37 paragraph (1) Law in Office of the Notary to to give legal service in the field of office of notary freely to those who are not capable cannot afford well though it has applied penalized for violators, according to the provisions of article 37 paragraph (2). Due to legal for notary who do not implimenting article 37 paragraph (1) could get the penalized. Sanction accordance to the article 37 paragraph (2) Law in Office of the Notary is oral warning, written warning, temporary dismissal, dismissal with respect, or dismissal with disrespect. The sanction in accordance to the Ethic Code of Notary is rebuke, warning, schorsing (firing temporary) from the membership of gathering, onzetting (firing) from the membership of gathering, and dismissal with disrespect from association of membership. The supervisor assembly of notary is not the part from professional notary organization cause it is form by the minister according to the provisions of article 67 paragraph
