Teknologi informasi saat ini berkembang sangat pesat dan memberikan pengaruh cukup besar dalam kehidupan masyarakat, termasuk di bidang kenotariatan. Penyelenggaraan Rapat Umum Pemegang Saham (RUPS) melalui video konferensi, merupakan contoh konkrit yang perlu dibuatkan risalahnya oleh Notaris. Risalah RUPS seperti itu harus ditandatangani oleh para peserta RUPS secara elektronik. Masalahnya, sampai saat ini belum ada landasan hukum yang menjamin keabsahan dari pembubuhan tanda tangan tersebut. Penelitian ini bertujuan mengkaji landasan hukum terkait dengan pembuatan risalah RUPS yang diselenggarakan melalui video konferensi oleh Notaris dan keabsahan tanda tangan elektronik pada risalah RUPS tersebut. Jenis penelitian yang digunakan yaitu yuridis normatif dan didukung dengan kajian yuridis empiris. Selain mengumpulkan data dengan menggunakan studi kepustakaan, juga didukung dengan wawancara dengan 3 (tiga) orang yang berprofesi sebagai Notaris/PPAT. Hasil penelitian menyimpulkan bahwa belum ada landasan hukum yang jelas mengenai pembuatan risalah RUPS oleh seorang Notaris yang diselenggarakan melalui video konferensi dan keabsahan tanda tangan elektronik pada risalah RUPS tersebut./ Information technology is currently developing very rapidly and has a considerable influence on people's life, including in the notary field. The execution of the General Meeting of Shareholders (GMS) through video conference, is a concrete example that a Notary needs to make the minutes. Such minutes of the GMS must be electronically signed by the GMS participants. The problem is, until now there is no legal basis that guarantees the validity of the affixing of the signature. This research aims to examine the legal basis related to the making of the minutes of the GMS held through video conference by a Notary and the validity of the electronic signature on the minutes of the GMS. The type of research used is normative juridical and supported by empirical juridical studies. In addition to collecting data using library research, it is also supported by interviews with 3 (three) people who work as Notary/PPAT. The results of the research conclude that there is no clear legal basis regarding the making of the minutes of the GMS by a Notary held through video conference and the validity of the electronic signature on the minutes of the GMS.
