Abstract
Each agreement is subject to the law of engagement, so that an agreement must be
carried out in good faith as stipulated in Article 1338 of Burgerlijk Wetboek. In
the community there are often buying and selling agreements that cause legal
disputes, especially in buying and selling land, including the sale and purchase of
land owned by someone else, where the land does not belong to the seller.
Therefore it is necessary to conduct further research related to legal protection for
land buyers with good intentions by reviewing a court decision as a case study to
know and understand the suitability of the legal protection. In this normative legal
research, data collection is done by library research with a legal principles
approach, and using secondary data types in the form of primary, secondary, and
tertiary legal. From the results of these studies, it can be concluded that legal
protection for land buyers with good intentions is to decide on the restoration of
their rights in accordance with Article 1267 of Burgerlijk Wetboek. More
appropriate legal application of a negligent agreement carried out by the seller
because it does not fulfill the principle of good faith and a reason that lawful is
null and void, because before the default of seller, the agreement has been
canceled first null and void. As a result of the cancellation of the agreement, the
situation must be returned as before and the party who is harmed in this case the
buyer can request reimbursement of costs, losses, and interest to the seller. / Setiap perjanjian tunduk pada hukum perikatan, sehingga suatu perjanjian harus
dilaksanakan dengan itikad baik sebagaimana diatur dalam Pasal 1338 KUHPer.
Dalam masyarakat sering terjadi perjanjian jual beli yang menimbulkan sengketa
hukum, khususnya dalam jual beli tanah, antara lain adanya jual beli tanah milik
orang lain, di mana tanah tersebut bukan milik si Penjual. Maka dari itu perlu
dilakukan penelitian lebih lanjut terkait perlindungan hukum bagi Pembeli tanah
yang beritikad baik dengan menelaah suatu putusan pengadilan sebagai studi
kasus untuk mengetahui dan memahami kesesuaian perlindungan hukum tersebut.
Dalam penelitian hukum normatif ini, pengumpulan data dilakukan dengan
penelitian kepustakaan dengan pendekatan asas-asas hukum, serta menggunakan
jenis data sekunder berupa bahan hukum primer, sekunder, dan tersier. Dari hasil
penelitian tersebut, dapat disimpulkan bahwa perlindungan hukum bagi Pembeli
tanah yang beritikad baik adalah dengan memutus pemulihan hak-haknya sesuai
dengan Pasal 1267 KUHPer. Penerapan hukum yang lebih tepat terhadap suatu
perjanjian yang lalai dilaksanakan oleh Penjual karena tidak dipenuhinya asas
itikad baik dan suatu sebab yang halal ialah Batal Demi Hukum, karena sebelum
terjadinya Wanprestasi oleh Penjual, Perjanjian telah lebih dulu batal. Akibat dari
batalnya perjanjian, maka keadaan harus dikembalikan seperti semula dan pihak
yang dirugikan dalam hal ini Pembeli dapat meminta penggantian biaya, kerugian,
dan bunga kepada Penjual.
