The development of information technology has encouraged public activities from conventional to digital ways, including the implementation of the General Meeting of Shareholders (GMS) of public companies that use electronic systems. Therefore, the Financial Services Authority issued a Regulation of the Financial Services Authority of the Republic of Indonesia Number 16/POJK.04/2020 to regulate the electronic implementation of GMS and require that the minutes of GMS be made by a notary public in the form of a notarized deed. In contrast to Law No. 40 of 2007 concerning Limited Liability Companies, the minutes of the electronic GMS deed of public companies do not need to be signed by the participants of the GMS. Therefore, research is required to see the regulation and validity of the minutes of GMS electronically unsigned by GMS participants. This research is normative legal research with empirical research support and by using statutory approach and case approach. From this research, it was concluded that the minutes of the GMS of public companies conducted electronically, which were not signed by the GMS participants as stipulated in the Regulation of the Financial Services Authority of the Republic of Indonesia Number 16/POJK.04/2020, remain legally valid and can provide legal certainty / Perkembangan teknologi informasi telah mendorong aktivitas masyarakat dari cara konvensional ke cara-cara digital, diantaranya pelaksanaan Rapat Umum Pemegang Saham (RUPS) perusahaan terbuka yang menggunakan sistem elektronik. Untuk itu, Otoritas Jasa Keuangan menerbitkan Peraturan Otoritas Jasa Keuangan Republik Indonesia Nomor 16/POJK.04/2020 untuk mengatur penyelenggaraan RUPS secara elektronik dan mewajibkan risalah RUPS dibuat oleh notaris dalam bentuk akta notaris. Berbeda dengan Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas, akta risalah RUPS elektronik perusahaan terbuka tidak perlu ditandatangani oleh peserta RUPS. Sehubungan dengan itu, diperlukan penelitian untuk melihat pengaturan dan keabsahan akta risalah RUPS perusahaan terbuka secara elektronik yang tidak ditandatangani oleh peserta RUPS. Penelitian ini merupakan penelitian hukum normatif dengan dukungan penelitian empiris dan dengan menggunakan pendekatan perundang-undangan dan pendekatan kasus. Dari penelitian ini, diperoleh kesimpulan bahwa akta risalah RUPS perusahaan terbuka yang dilakukan secara elektronik, yang tidak ditandatangani oleh peserta RUPS sebagaimana diatur dalam Peraturan Otoritas Jasa Keuangan Republik Indonesia Nomor 16/POJK.04/2020, tetap sah secara hukum dan dapat memberikan kepastian hukum.
