Abstract
Asas Hukum Pertanahan di Indonesia menyatakan bahwa tanah dan kekayaan alam lainnya yang berada di wilayah Indonesia dikuasai oleh Negara dan dipergunakan untuk sebesar-besarnya kemakmuran rakyat. Hal ini mengakibatkan penerapan batas waktu untuk sebagian besar jenis hak kepemilikan atas tanahnya. Tulisan ini akan menelusuri keberadaan hak prioritas untuk mengajukan pembaruan hak atas tanah bagi mantan pemilik hak atas tanah dalam kaitannya dengan praktik sengketa pengalihan hak atas tanah prioritas yang dibuat dalam bentuk akta notaris. Menurut Putusan Pengadilan No. 147/PK/PID.SUS/2014, pengalihan hak atas tanah prioritas antara PT Nelayan Bakti dan Pemerintah Kota Ternate dipandang sebagai perbuatan penjualan tanah milik negara yang mana perbuatan tersebut melawan hukum dan diancam dengan pidana. Notaris sebagai pembuat akta bertanggung jawab atas segala akta yang telah dibuat selama menjabat sebagai notaris sebagaimana diatur dalam Pasal 65 Undang-Undang Jabatan Notaris. Jenis metode penelitian yang digunakan dalam tulisan ini adalah normatif empiris dengan pendekatan perundang-undangan yang diperkuat dengan pendekatan kasus, data-data dalam penelitian ini diperoleh dari wawancara dan studi kepustakaan. Hasil penelitian menunjukkan bahwa Peraturan Pemerintah Nomor 18 Tahun 2021 telah menunjukkan eksistensi serta meningkatkan pengakuan hak prioritas atas tanah. Pelimpahan hak prioritas diperoleh secara otomatis bagi bekas pemegang hak, penetapan pengadilan dan akta pelimpahan hak prioritas. Apabila pembuatan akta pelimpahan hak prioritas tidak sesuai dengan peraturan perundang-undangan, Notaris wajib bertanggung jawab secara pidana./The Land Law Principle in Indonesia states that land and other natural resources within Indonesian territories are to be controlled by the State and utilized for the purpose of its public welfare. This resulted in the implementation of time limits for most of its land ownership’s rights. The paper will explore the existence of priority rights to apply land right renewal for former land right owners in relation to the contentious practice of priority land right transfers made in the form of notarial deed. According to Court Decision No. 147/PK/PID.SUS/2014, priority land right transfer between PT Nelayan Bakti and the Government of Ternate City is viewed as an act of transferring state-controlled land in which such act is unlawful and punishable by law. Public notary as a deed maker is responsible for all of the deeds that have been made during the tenure of notary as stipulated in Article 65 Office of Notary Public Law. The type of research method used in this paper is normative empirical with statute and case approach by obtaining data from interviews and literature study. The study found that the introduction of Government Regulation Number 18 Year 2021 has improved the acknowledgement of priority land rights. Priority land rights can be obtained through 3 (three) methods: automatically for previous land owners, courts decision and land priority right transfer deed. If a land priority right transfer deed made by Notary is not in accordance to prevailing law, Notary can be held criminally responsible for it.
