Abstract

Notaris adalah pejabat umum yang salah satunya mempunyai wewenang untuk membuat akta autentik. Dalam prakteknya Notaris membuat akta PPJB dan kuasa menjual berkaitan dengan peralihan hak atas tanah. Berdasarkan Instruksi Menteri Dalam Negeri Nomor 14 Tahun 1982 tentang Larangan Penggunaan Kuasa Mutlak sebagai Pemindahan Hak Atas Tanah (selanjutnya disebut Instruksi Mendagri No. 14/1982), kuasa mutlak tidak diperbolehkan atau dilarang, karena mengandung unsur yang tidak dapat ditarik kembali oleh pemberi kuasa, dan suatu pemindahan hak atas tanah yang memberikan kewenangan kepada penerima kuasa untuk menguasai dan menggunakan tanahnya serta melakukan perbuatan hukum yang menurut hukum hanya dapat dilakukan oleh pemegang haknya, selain itu dapat merugikan Negara. Peralihan hak atas tanah harus dilaksanakan sesuai dengan peraturan perundang-undangan, maka sudah sewajarnya Notaris/PPAT sebagai pejabat yang berwenang dalam membuat suatu perjanjian tidak bertentangan dengan Instruksi Mendagri No. 14/1982 dan Pasal 39 ayat 1 huruf d Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah. / A notary is a public official, one of whom has the authority to make an authentic certificate. In practice, the Notary makes a PPJB certificate and power of selling related to transitional land rights. Based on Minister of Home Affairs Instruction Number 14 of 1982 concerning the Prohibition of the Use of Absolute Power as Transition Land Rights (hereinafter referred to as Instruction of the Minister of Home Affairs No. 14/1982), absolute power is not allowed or prohibited, because it contains elements that cannot be withdrawn by the power of attorney, in fact it’s a transitional land rights that gives the authority to the authorized of the power to control and use the land as well to carry out legal actions which according to law could only be carried out by right holder, otherwise it could be detrimental to the Country. Transition land rights must be carried out in accordance with existing law, so Notary/PPAT as the authorized official in making agreements should and should not conflict with the Minister of Home Affairs Instruction No. 14/1982 and Article 39 paragraph 1 letter d of Government Regulation Number 24 of 1997 concerning Land Registration.
