Abstract

Notaris memiliki tanggung jawab dan kewenangan untuk membuat akta autentik yang diperlukan bagi masyarakat yang melakukan kegiatan jual beli. Namun ternyata akta perjanjian pengikatan jual beli yang dibuat oleh Notaris ternyata dapat memiliki unsur perbuatan melawan hukum yang dilakukan oleh para pihak yang ada dalam perjanjian tersebut. Hal ini menyebabkan banyak Notaris yang dituntut atas dasar unsur perbuatan melawan hukum tersebut. Penelitian ini melakukan penelitian melalui pendekatan perundang-undangan dan pendekatan kasus dan dari hasil penelitian dapat disimpulkan bahwa Notaris memiliki perlindungan hukum terhadap tuntutan perbuatan melawan hukum yang terjadi dalam perjanjian pengikatan jual beli tersebut yang ada dalam undang-undang terkait dengan profesi Notaris maupun KUH Perdata. Notaris juga bertanggung jawab atas akta autentik yang dibuatnya dengan batasan-batasan tanggung jawab yang diatur dalam perundang-undangan. Jika Notaris terbukti tidak melakukan perbuatan melawan hukum, maka Notaris tidak bertanggung jawab atas hal tersebut/Notary has the responsibility and authority to make authentic deeds needed for people who carry out buying and selling activities. However, it turns out that the deed of the sale and purchase agreement made by the Notary may have elements of illegal acts committed by the parties in the agreement. This causes many Notaries to be prosecuted on the basis of the element of the unlawful act (tort). This study conducts research through statutory approach and case approach and from the results it can be concluded that Notary has legal protection against claims for illegal acts that occur in the sale and purchase agreement which is in the law related to the profession and Civil Code. Notary is also responsible for the authentic deed he makes with the limits of responsibility set out in legislation. If the Notary is proven not to have committed an illegal act, the Notary is not held responsible.
