Abstract

Tujuan penelitian ini adalah untuk mengetahui faktor yang menjadi penyebab anak dieksploitasi untuk bekerja dan menggambarkan perlindungan hukum ketenagakerjaan terhadap anak yang dieksploitasi untuk bekerja di jalanan. Penelitian ini adalah penelitian normatif, yakni mengkaji peraturan perundang-undangan terkait pekerja anak dan eksploitasi anak bekerja di jalanan. Data yang digunakan adalah data sekunder, bersumber dari peraturan perundang-undangan, hasil penelitian lembaga dan perorangan tentang pekerja anak, serta teori atau pendapat para ahli. Metode pengumpulan data melalui studi kepustakaan di perpustakaan dan media internet. Pendekatan penelitian undangan (statute approach). Analisis data dilakukan secara kualitatif. Hasil penelitian menunjukkan, faktor yang menyebabkan anak d ieksploitasi untuk bekerja di jalanan adalah kemiskinan yang mendorong seluruh anggota keluarga mencari nafkah; lingkungan sosial keluarga yang tidak baik dan tidak bertanggung jawab membuat anak sebagian besar hidupnya dihabiskan di jalanan untuk bekerja apa saja, kultur masyarakat yang memandang jenis kelamin sebagai pertimbangan untuk melibatkan anak untuk bekerja, lemahnya Perangkat Hukum dan Pengawasan dari Pemerintah, orang tua dan masyarakat. Perlindungan Hukum Ketenagakerjaan Terhadap Anak Yang Dieksploitasi Untuk Bekerja di Jalanan diatur dalam UU No 1 Tahun 2000 tentang Pengesahan Konvensi ILO No. 182 Tahun 1999 untuk menghapus bentuk-bentuk pekerjaan terburuk bagi anak dan batas usia pekerja anak adalah 15 tahun. KHA jo. UU Perlindungan Anak KHA memberi 4 prinsip perlindungan anak; UU Ketenagakerjaan memungkinkan anak bekerja, perlindungannya hak atas upah, jam kerja, waktu istirahat dan liburan, pendidikan, dan hak moral, keselamatan dan kesehatan kerja. Larangan mempekerjakan anak pada pekerjaan yang terburuk dengan sanksi pidana penjara dan atau denda./The purpose of this study is to determine the factors that cause children to be exploited to work and to describe the legal protection of labor for children who are exploited to work on the streets. This research is a normative research, which examines the laws and regulations related to child labor and the exploitation of children working on the streets. The data used are secondary data, sourced from laws and regulations, the results of research by institutions and individuals on child labor, as well as theories or expert opinions. The method of data collection is through literature study in the library and internet media. Invitation research approach (statute approach). Data analysis was carried out qualitatively. The results show that the factors that cause children to be exploited to work on the streets are poverty which encourages all family members to earn a living; the family's social environment is not good and is not responsible for making children spend most of their lives on the streets to work anything, the culture of society that views gender as a consideration for involving children to work, weak legal instruments and supervision from the government, parents and society. Labor Law Protection for Children Exploited to Work on the Streets is regulated in Law No. 1 of 2000 concerning Ratification of ILO Convention No. 182 of 1999 to abolish the worst forms of child labor and the age limit for child labor is 15 years. KHA jo. The KHA Child Protection Law provides 4 principles of child protection; The Labor Law allows children to work, the protection of the right to wages, working hours, rest and vacation time, education, and moral rights, occupational safety and health. Prohibition of employing children in the worst jobs with imprisonment and/or fines.
