Abstract

Penelitian ini bertujuan untuk mengetahui perlindungan hukum terhadap merek terdaftar dalam perdagangan di Indonesia, untuk mengetahui penerapan pengaturan hukum merek terhadap praktek persaingan usaha curang serta untuk mengetahui penegakan hukum dalam praktek persaingan usaha curang untuk melindungi merek terdaftar. Metode penelitian yang digunakan yaitu jenis penelitian normatif yakni penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder. Adapun pengumpulan data dilakukan dengan teknik kepustakaan yaitu mengkaji undang-undang terkait dan menggunakan literatur terkait. Sedangkan analisis data yang digunakan adalah kualitatif, yaitu menguraikan data dalam bentuk kalimat yang tersusun secara sistematis, jelas dan terperinci yang kemudian diinterpretasikan untuk memperoleh suatu kesimpulan. Hasil penelitian ditemukan bahwa perlindungan hukum atas merek terdaftar dalam perdagangan di Indonesia terutama dalam suatu persaingan usaha curang yaitu berupa perlindungan hukum yang diberikan oleh pemerintah bagi para pemegang hak merek atas pelanggaran merek salah satunya pelanggaran perkara peniruan terhadap merek-merek terkenal. Saat ini, Indonesia melalui undang- undang secara khusus telah merumuskan bagi pemegang hak merek untuk dapat diberikan sebuah hak yang sifatnya eksklusif (khusus) bagi pemilik merek (exclusive right) agar pihak lain tidak dapat menggunakan tanda yang sama atau mirip dengan yang dimilikinya baik untuk barang atau jasa yang sama atau hampir sama.Adapun perlindungan hukum yang dapat diberikan adalah sebagai berikut. Pertama, ada 2 (dua) perlindungan hukum yaitu perlindungan hukum preventif dan perlindungan hukum represif. Kedua, penerapan pengaturan hukum merek terhadap praktek persaingan usaha curang yaitu diatur di dalam Undang-Undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis (UU MIG) dan Undang-Undang Nomor 5 Tahun 1999 Tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat (UU LMP). Ketiga, penegakan hukum dalam memberikan perlindungan bagi pemegang hak merek terdaftar pada praktik persaingan usaha yaitu dijelaskan di dalam Pasal 100-102 UU MIG./This study aims to determine the legal protection of registered trademarks in trade in Indonesia, to determine the application of trademark law regulations against fraudulent business competition practices and to determine law enforcement in fraudulent business competition practices to protect registered marks. The research method used is a type of normative research, namely legal research conducted by examining library materials or secondary data. The data collection was carried out using literature techniques, namely reviewing related laws and using related literature. While the data analysis used is qualitative, which describes the data in the form of sentences arranged systematically, clearly and in detail, which are then interpreted to obtain a conclusion. The research found that first, legal protection for registered marks in trade in Indonesia, especially in a fraudulent business competition, namely in the form of legal protection provided by the government for trademark rights holders for trademark infringement, one of which is the infringement of cases of imitation of well-known brands. At present, Indonesia through law has specifically formulated trademark rights holders to be granted an exclusive right for the trademark owner (exclusive right) so that other parties cannot use the same or similar mark as theirs either to the same or nearly the same goods or services. First,, The legal protection can be given 2 (two) legal protections, namely preventive legal protection and repressive legal protection. Second, the application of trademark law regulations against fraudulent business competition practices, which is regulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications (MIG Law) and Law Number 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition LMP). Third, law enforcement in providing protection for registered trademark rights holders in business competition practices, which is described in Articles 100-102 of the MIG Law.
