Housing and Settlement are basic human needs that are very influential in the forming of a nation’s personality. Housing and Settlement are two things that could not only be seen as a means of living necessities, but they are both more than that. It is a process of human settling in order to create a living order for the community and themselves in revealing their identity. The need for a house has always been a primary need for everyone, but on the other hand, sometimes the land that’s available in the urban areas for housing construction is limited. Therefore, buying property from a developer is one of the steps that could be considered practical. However, sometimes, a consumer’s trust in the credibility and promises which were offered were often misused by the developer. In the case of decision number 14/Pdt.Sus-Pailit/2018/PN.Niaga.Jkt.Pst, PT. Arm Cipta Mulia Development is a developer who went bankrupt at the request of his consumer. In this case, the author wants to examine the legal protection for consumers of housing units against the developer who is declared bankrupt in the bankruptcy case of 14/Pdt.Sus-Pailit/2018/PN.Niaga.Jkt.Pst and how did the judges of the Central Jakarta Commercial Court decide to accept the application for a declaration of bankruptcy. In order to reach the answers to the problems that arise, the author’s research methods that was used in this paper’s the normative legal research while the approach methods that were used in this paper were the statute approach and the case approach. The conclusion that needed to be reached were how the consumer in this case deserve and could be protected through the Housing and Settlement Law, Consumer Protection Law, and Bankruptcy Law; and the considerations that the judges made to grant the Application for Bankruptcy Case Decision Number 14/Pdt.Sus-Pailit/2018/PN.Niaga.Jkt Pst.
