Abstract
The establishment of Law No. 30 of 2014 is the basis of protection for government’s actions, where government’s actions, as long as their purpose is for public interest, are therefore considered valid, especially in emergency situation. However, the threshold for government action to be considered valid is if the government's actions are carried out based on the laws that regulate it and/or based on the General Principles of Good Governance. In the case of government’s actions in throttling and disconnecting the internet network in the middle of riot situation, there is a lack clarity and legal certainty within the law which results to misinterpretation, so that the government's actions in protecting the public interest are practically unclear, despite considered as unlawful acts according to the Administrative Court.
