Penelitian ini membahas mengenai perlindungan hukum bagi konsumen atas hak kepemilikan satuan rumah susun dalam kasus kepailitan. Penelitian ini menggunakan tipe penelitian Yuridis Normatif-Dogmatik dimana metode penelitian dilakukan melalui studi kepustakaan dengan menggunakan Pendekatan Undang- Undang (Statutes Approach), Pendekatan Konsep (Conceptual Approach), dan Pendekatan Kasus (Case Approach). Tujuan dari penelitian ini adalah untuk menganalisis bentuk perlindungan hukum yang dapat diberikan kepada konsumen satuan rumah susun yang dirugikan akibat kepailitan perusahaan pengembang. Hasil penelitian menunjukan bahwa kepailitan perusahaan pengembang cenderung merugikan konsumen yang telah membayar lunas namun hanya memegang Perjanjian Pengikatan Jual Beli. Konsumen belum memperoleh hak kepemilikan atas satuan rumah susun akibat pengembang belum membuat Akta Jual Beli. Undang – Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen telah memberikan perlindungan hukum bagi konsumen yang dirugikan. Dalam hal ini, bentuk perlindungan yang diberikan Undang-Undang Perlindungan Konsumen bagi konsumen satuan rumah susun adalah dengan menempuh jalan penyelesaian sengketa melalui pengajuan gugatan baik litigasi maupun non-litigasi. / This research examined the legal protection for consumer of ownership rights over apartment units in bankruptcy case. This research uses a type of Normative Dogmatic Juridical research in which the research methods conducted by literature study with Statutes Approach, Conceptual Approach, and Case Approach. The purpose of this research is to analyze the form of legal protection that can be given to consumer of apartment units who are harmed by the bankruptcy of the developer company. The result of the research shows that the bankruptcy of developer company tends to harm consumer who have fully paid but only hold a Sale and Purchase Binding Agreement. The consumer has not obtained the ownership rights over the apartment units due to the Sale and Purchase Notarial Deed that have not been made by the developer company. Law Number 8 of 1999 concerning Consumer Protection has provided legal protection for the harmed consumer. In this case, the form of legal protection provided by the Consumer Protection Law for consumer of apartment units is to take the dispute resolution through filing a lawsuit, both litigation and non-litigation.
