Abstract

Dalam penelitian ini akan membahas tentang perlindungan hukum bagi pihak ketiga yang tidak dilibatkan dalam perkara namun hak-haknya dirugikan akibat adanya putusan pengadilan atau penyitaan terhadap harta benda miliknya. Penelitian ini menggunakan metode penelitian Yuridis-Normatif yang diperoleh dari studi kepustakaan. Tujuan dari penelitian ini adalah untuk menganalisis jangka waktu pengajuan derden verzet terhadap sebuah putusan pengadilan atau penyitaan. Dalam praktiknya, hal ini sering menjadi perdebatan dalam persidangan perkara perlawanan pihak ketiga di pengadilan karena adanya pendapat bahwa derden verzet tidak dapat diajukan setelah ada putusan yang berkekuatan hukum tetap dan menimbulkan ketidakpastian hukum bagi pihak ketiga untuk mempertahankan hak-haknya. Dalam hal ini, para ahli hukum telah memberikan pandangannya terhadap jangka waktu pengajuan derden verzet./This research will examine about legal protection for third parties outside the case but his rights are being violated because of jurisprudence or confiscation of their property. The research uses Normative-Juridical method which conducted by literature study. The purpose of this research is to analyze time period of derden verzet submission against a jurisprudence of confiscation. In practice, there are often debates regarding the issue above in the court room because there are some opinion from law experts saying derden verzet cannot be submitted to legally binding jurisprudence and causes legal uncertainty regarding derden verzet as legal protection for third parties to maintain their rights. In this there are others law experts that explain more about derden verzet and its time period.
