Abstract
Era digital ditandai dengan perkembangan teknologi, arus informasi yang cepat,
hingga penggunaan teknologi dalam semua bidang kehidupan. Perkembangan dan
kemajuan teknologi informasi ini mengakibatkan adanya kegiatan hukum baru yang
dilakukan secara virtual atau dunia maya, seperti transaksi elektronik. Selain
berbagai kelebihan yang ditawarkan dari transaksi elektronik online, terdapat
peluang resiko yang dapat merugikan konsumen, contohnya dalam Kasus e�commerce GrabToko. Tipe penelitian ini adalah Yuridis Normatif yang dilakukan
melalui kajian studi pustaka, yaitu berdasarkan bahan – bahan hukum. Tidak
terpenuhinya hak – hak konsumen melahirkan sengketa konsumen yang dapat
diselesaikan melalui jalur litigasi melalui pengadilan atau non litigasi melalui
Badan Penyelesaian Sengketa Konsumen (BPSK). GrabToko yang melakukan
wanprestasi terhadap konsumennya melanggar ketentuan Pasal 17 ayat (2) UU ITE
dan perbuatan yang dilarang dalam Pasal 28 ayat (1) UU ITE yang mengakibatkan
kerugian konsumen jo Pasal 1338 ayat (3) KUHPerdata dan Pasal 1246
KUHPerdata jis Pasal 16 UU PK dengan sanksi yang diatur dalam Pasal 62 ayat (2)
UU PK. Dengan demikian Pihak GrabToko wajib memberikan ganti kerugian
kepada konsumen berupa biaya, rugi, dan bunga. Para konsumen yang dirugikan
dapat menyelesaikan sengketa melalui gugatan perdata dengan mengajukan
gugatan Class Action, dengan memperhatikan Hukum Acara Perdata dan PERMA
1 Tahun 2002 tentang Acara Gugatan Perwakilan Kelompok. / The digital era is marked by technological development, rapid information flow, up
to the use of technologies in all areas of life. Developments and advances in
information technology resulted in new legal activities that are performed virtually
or online, such as electronic transaction. Despite having many advantages offered
by electronic transactions, there are potential risks that could cause disadvantages
for consumers, for example in E-commerce GrabToko’s case. This juridical
normative research is conducted through a series of library studies, which is based
on legal materials. Since the rights of consumer are not fulfilled, it ultimately lead
to consumer disputes that could be carried out through litigation or non – litigation
dispute resolution mechanism. Breach of contract by GrabToko is a violation of
Article 17 section (2) and prohibited act in Article 28 section (1) Law on Electronic
Information and Transaction that resulted in consumer losses juncto Article 1338
section (3) and Article 1246 of Indonesian Civil Code jis Article 16 with the
sanctions regulated in Article 62 section (2) of Consumer Protection Law. Thus
GrabToko is obligated to provide compensation to consumers in the form of fees,
looses and interest. Therefore consumers can settle their disputes through filling a
Class Action lawsuit, taking into account the Indonesian Civil Code Procedure and
Supreme Court Rules 1 of 2002 concerning Class Action Lawsuit.
