Sailing activites aimed to catch fish are one of many methods to utilize Indonesia’s vast fisheries. The law has also regulated various requirements that must be complied before doing any sailing activities to ensure the safety of sailing fishing vessels. However, violation of regulations in form of torts can occur that may result in someone’s death and causes damages as we can see in decision number 25/Pdt.G/2018/PN.Rbg. Plaintiff demanded compensation for the death of the plaintiff’s husband due to the sinking of KM Cahaya Indah ship that happened because of the negligence of the defendants who did not comply with the law. This research aims to analyze how the action of the defendants in decision number 25/Pdt.G/2018/PN.Rbg can be classified as torts, and to find out a proper compensation towards torts that causes someone’s wrongful death. The method used in this research is normative research, this research used secondary data that was obtained through literature study. This research use legal system and case study approach, and data in this research will be analyzed qualitatively. The results of this research show that the action of the defendants have fulfilled the elements of torts. A proper compensation towards torts that causes someone’s wrongful death is the judge’s authority to determine based on ex aequo et bono, by considering feasibility and propriety, position, and wealth of both parties, circumtances, justice, fairness, and appropriateness.
