Abstract

Unbeknownst to us, our daily lives have been riddled with the suffering of animals. The food we consume, the clothing we use daily, to the medicines that are meant to help us feel better may all be thanks to animals that fell victim towards abuse by companies. Not doing the actual research on these companies or choosing not to, makes us complicit to animal cruelty. Many individuals take it a step further, by neglecting their responsibilities as pet owners and actively mistreating animals in the guise of fun and entertainment. Fishing, hunting, petting zoos, and even the movies we enjoyed may all be tainted with animal cruelty. Some individuals even post cruel acts towards animals on social media, Indonesia being the country with most of these kinds of content online. These are just a few of the many actions that can be classified as animal cruelty. This paper aims to find clarity in regards to the classifications of animal cruelty from Indonesia’s Criminal Code Article 302 and other regulations, as well as to analyze the concept of animal protection in criminal law according to the theory of dignified justice. This study uses a normative juridical approach and deductive reasoning methods. The results of this study indicates that Indonesia’s less than satisfactory implementation of the criminal code regarding to animal cruelty is due to the lack of regulations made towards the subject, as well as the lack of awareness, concern, and participation among the majority of Indonesia’s citizens. Under those circumstances, the author will discuss further regarding what constitutes as animal cruelty itself, the regulations based on Indonesia’s Criminal Code according to the theory of dignified justice, as well as some practical ways in hopes to decrease the number of victims due of animal cruelty.
