Abstract

Eutanasia adalah tindakan membunuh seseorang tanpa rasa sakit. Eutanasia secara garis besar digolongkan menjadi dua jenis, yaitu aktif dan pasif. di Indonesia baik eutanasia aktif maupun pasif tidak memiliki pengaturan yang jelas, akibat tidak adanya pengaturan yang jelas maka eutanasia di Indonesia dikategorikan sebagai perbuatan pembunuhan. maka bagi orang-orang yang terlibat khususnya pemohon eutanasia di dalam persoalan hukum kesehatan yang berdampak hukum pidana harus mendapatkan kepastian dan perlindungan hukum yang tepat. Berbeda dengan Negara Belanda yang memberlakukan pengaturan progresif tentang eutanasia yang membuat kepastian dan perlindungan hukum pemohon eutanasia dinilai memadai. sehingga penelitian ini bermaksud untuk untuk membahas pengaturan dan kepastian hukum terhadap pemohon eutanasia di Indonesia dan Belanda yang telah melegalkan praktik eutanasia serta perlindungannya. Penelitian ini menggunakan metode penelitian hukum normatif, diikuti dengan pendekatan undang-undang, pendekatan komparatif, dan pendekatan konseptual untuk menghasilkan analisis kualitatif dan induktif. Penelitian ini akan menjadi kontribusi literatur akademis berdasarkan analisis bahwa 1) Pengaturan di Indonesia mengenai eutanasia ialah 344 KUHP yang menyatakan sebenarnya baik eutanasia aktif maupun pasif merupakan perbuatan melawan hukum. namun, tidak ada kejelasan mengenai pengaturan ini menimbulkan kurangnya kepastian dan perlindungan hukum bagi pemohon eutanasia. 2) Negara Belanda memiliki peraturan khusus mengenai eutanasia sehingga kepastian dan perlindungan pemohon eutanasia lebih memadai, meskipun eutanasia dilegalkan di Negara tersebut, namun ada kriteria yang harus dipenuhi oleh pasien agar permintaannya mati secara bermartabat dapat dipenuhi atau diperbolehkan untuk melakukan eutanasia / Euthanasia is the act of killing someone without pain. Euthanasia is broadly classified into two types, namely active and passive. In Indonesia, both active and passive euthanasia do not have clear regulations, due to the absence of clear regulations, euthanasia in Indonesia is categorized as an act of murder. So, for people who are involved, especially applicants for euthanasia, in health law issues that have an impact on criminal law, they must get the right legal certainty and protection. In contrast to the Netherlands, which enforces progressive arrangements on euthanasia, which makes the legal certainty and protection of euthanasia applicants considered adequate. so that this study intends to discuss the regulation and legal certainty of euthanasia applicants in Indonesia and the Netherlands who have legalized the practice of euthanasia and its protection. This study uses a normative legal research method, followed by a legal approach, a comparative approach, and a conceptual approach to produce qualitative and inductive analysis. This research will contribute to the academic literature based on the analysis that 1) The regulation in Indonesia regarding euthanasia is 344 of the Criminal Code which states that both active and passive euthanasia is against the law. however, the lack of clarity regarding this arrangement creates a lack of legal certainty and protection for euthanasia applicants. 2) The Netherlands has special regulations regarding euthanasia so that the certainty and protection of euthanasia applicants is more adequate, although euthanasia is legal in that country, there are criteria that must be followed by patients so that their request to die with dignity can be fulfilled or allowed to perform euthanasia
