Technology is one of the contributing factors to a country's progress. One of the fastest growing technologies is the internet. The presence of the internet is expected to provide convenience in interacting and fulfilling the position of humans as social creatures. The internet itself also changes distance and time so that the world feels narrow. Over time the ease being abused by irresponsible individuals. One form of this abuse is the spread of fake news or often called hoaxes. The spread of fake news (hoax) is the act where someone preaches an information that contains untrue elements or lies. Seeing the existence of a violation, Indonesia as a legal state acted on this by regulating the act in Law No. 1 of 1946 concerning the Regulation of Criminal Law and Law No. 19 of 2016 concerning Electronic Information and Transactions. This is given that a criminal offence can only be acted upon when it has been arranged ("nullum delictum nulla poenali sine praevia lege poenali") This research aims to understand the laws governing fake news and understand the criminal liability of the perpetrators of the spread of fake news. This research is a juridical legal research using library study methods against primary and secondary data. The data analyst technique used is interpretive analysis. Where the problem approach used is the legal approach. The result of this study is the accountability of the perpetrator for the criminal act of spreading fake news (hoax).
