Abstract
Tesis ini membahas mengenai perbuatan melawan hukum yang dilakukan notaris terhadap pemindahan hak atas tanah, yang mana atas pemindahan hak atas tanah tersebut hanya didasarkan pada covernote notaris. Bahwa mengenai covernote tidak ada aturan hukum yang mengaturnya, karena didasarkan pada kebiasaan notaris dalam praktik, serta menjadi tanggung jawab notaris tersebut dalam membuatnya. Mengenai pemindahan hak atas tanah juga harus diketahui dahulu mengenai dasar alas hak tanah tersebut, kemudian baru dapat dilakukan transaksi jual beli dengan objek yang memiliki dasar alas hak yang jelas. Pada umumnya, pemberian jaminan kredit pemilikan rumah yang surat-suratnya masih dalam pengurusan, notaris secara kebiasaannya akan mengeluarkan covernote kepada pihak bank untuk dicairkan kredit kepemilikan rumah dimaksud, namun apabila covernote tersebut dijadikan dasar peralihan, akan terjadi kekeliruan yang dapat menimbulkan dampak hukum, yakni perbuatan melawan hukum, terutama bila diketahui ternyata objek yang diperjualbelikan tidak memiliki alas hak yang jelas seperti sertifikat hak milik. Maka notaris juga wajib bertanggung jawab terhadap produk covernote yang dibuatnya/This thesis discusses the unlawful actions committed by notaries against the transfer of land rights, which on the transfer of land rights are based only on the covernote notary. That regarding the covernote there is no rule of law governing it, because it is based on the habits of notaries in practice, as well as the responsibility of the notary in making it. Regarding the transfer of land rights must also be known first about the basis of the land rights base, then only can be done buying and selling transactions with objects that have a clear basis of rights. In general, the provision of home ownership credit guarantees whose letters are still in management, notaries will customarily issue covernotes to the bank to disburse the ownership loan of the house, but if the covernote is used as a basis for transition, there will be errors that can cause legal impact, namely unlawful acts, especially if it is known that the object for sale does not have a pedestal of rights. It's like a certificate of property. So the notary must also be responsible for the covernote products he makes.
