Abstract

In the legal framework of Intellectual Property Rights, Copyright is a part of intellectual property that has scope in the field of science, art, and literature including computer software. As an exclusive right, the author has the monopoly right to announce and multiply his creations, and even have the privilege of obtaining moral rights therein. The level of computer software piracy in Indonesia which is quite high compared to other countries makes Indonesia need to make changes to respond to it, therefore the Law No. 28 of 2014 to improve the previous Copyright Act. One of the strategic considerations is to guarantee stronger legal protection for those who have rights to their work. If not resolved, then Copyright infringement will not only cause material loss but can also cause the loss of the passion of the creator to continue to develop creativity. / Dalam kerangka hukum Hak Kekayaan Intelektual, Hak Cipta merupakan salah satu bagian dari kekayaan intelektual yang memiliki ruang lingkup di bidang ilmu pengetahuan, seni, dan sastra termasuk didalamnya software komputer. Sebagai hak eksklusif, pencipta memiliki hak monopoli untuk mengumumkan dan memperbanyak ciptaannya, bahkan memiliki privilege untuk mendapatkan hak moral didalamnya. Tingkat pembajakan software komputer di Indonesia yang cukup tinggi dibandingkan negara lainnya membuat Indonesia perlu melakukan perubahan untuk menyikapinya, oleh karena itu disusun Undang Undang No. 28 Tahun 2014 guna menyempurnakan Undang Undang Hak Cipta sebelumnya. Salah satu pertimbangan strategisnya adalah untuk memberi jaminan perlindungan hukum yang lebih kuat bagi mereka yang memiliki hak atas ciptaannya. Apabila tidak diatasi, maka pelanggaran Hak Cipta bukan saja akan menimbulkan kerugian secara materiil namun juga dapat menyebabkan hilangnya gairah parah pencipta untuk terus mengembangkan kreatifitas.
