Abstract

The importance of maintaining the rights of businesses were lost due to violations of unfair competition as well as the consistency of the Commission in deciding the case is a matter for the analysis of how much legal protection owned by businesses that violated the breach of treaty practice closed and market control. In this study, data collection is done by using the approach of Legislation and real case. The decisions of the Commission related Closed Agreements and Market Control. From the results, it can be concluded that the agreement covered and market control provided for in Article 15 and Article 19 of Law No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Competition as well as the implementation rules. There were some aspects of the Commission's decision making inconsistencies lead to the adoption of a treaty arrangement closed and no maximum market share. / Pentingnya menjaga hak dari pelaku usaha yang hilang karena pelanggaran persaingan usaha yang tidak sehat serta konsistensi KPPU dalam memutus perkara merupakan bahan untuk analisa seberapa besar perlindungan hukum yang dimiliki oleh pelaku usaha yang terlanggar atas pelanggaran terhadap praktek perjanjian tertutup dan penguasaan pasar. Dalam penelitian ini, menggunakan metode penelitian normatif yuridis, pengumpulan data dilakukan dengan menggunakan pendekatan Perundang-Undangan dan pendekatan kasus, yaitu dengan menganalisis putusan-putusan KPPU terkait Perjanjian Tertutup dan Penguasaan Pasar. Dari hasil penelitian, dapat disimpulkan bahwa perjanjian tertutup dan penguasaan pasar diatur dalam Pasal 15 dan Pasal 19 UndangUndang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat beserta aturan pelaksanaanya. Terjadi beberapa aspek membuat inkonsistensi putusan KPPU yang mengakibatkan penerapan dari pengaturan perjanjian tertutup dan penguasaan pasar tidak maksimal.
