Shopee merupakan salah satu E-Commerce yang menawarkan berbagai macam produk dengan berbagai metode pengiriman serta berbagai metode pembayaran. Shopee memiliki fitur pembayaran Paylater dan dengan aktifya Paylater maka pihak penyedia dan pengguna Paylater memiliki prestasi yang saling disetujui dan harus ditepati, bila salah satu pihak tidak memenuhi prestasi maka dapat dilakukan upaya tanggung gugat sehingga tidak ada pihak yang merasa dirugikan. Tugas akhir ini bertujuan untuk mengetahui dan memahami perlindungan hukum yang dapat diajukan oleh pihak debitur Paylater atas kerugian yang dialami berdasarkan Undang-Undang Informasi dan Transaksaksi Elektronik. Tipe penelitian yang digunakan dalam skripsi ini adalah Statute Approach dan Conceptual Approach. Hasil analisis dari tugas akhir ini menunjukan, bahwa kerugian yang dialami oleh W diakibatkan oleh tindakan wanprestasi yang dilakukan oleh pihak Shopee sebagai penyedia layanan Paylater. Oleh sebab itu W sebagai pengguna Shopee Paylater dapat mengajukan perlindungan hukum sesuai dengan ketentuan Pasal 38 Ayat (1) Undang-Undang Informasi dan Transaksaksi Elektronik dan Pasal 39 Ayat (2) Undang-Undang Informasi dan Transaksaksi Elektronik untuk menyelesaikan perkara, dalam hal ini ketemtuan pidana bagi pihak Shopee diaturkan dalam Pasal 45 Ayat (2) dan (3) Undang-Undang Informasi dan Transaksaksi Elektronik. / Shopee is one of E-Commerce who offer many kind of products, with many kind of shipping options, and also many kind of payment methods. Shopee have a payment methods called Paylater and by the activation of Paylater the service provider and Paylater user had a performance that already agreed and so it must fulfilled if one of litigant doesn't fulfilled the performance then there will be an accountability action so there's no loss between the litigants. This thesis aims to know and understand the legal protections that can be filed by Paylater debtors for losses suffered under the Electronic Information and Transaction Act. The types of research used in this thesis are Statute Approach and Conceptual Approach. The results of the analysis of this thesis showed that the losses suffered by W resulted from default actions carried out by Shopee as a Paylater service provider. Therefore W as a user of Shopee Paylater can apply for legal protection in accordance with the provisions of Article 38 Paragraph (1) of the Electronic Information and Transacactation Act and Article 39 Paragraph (2) of the Electronic Information and Transacactation Act to resolve the case, in this case the criminal case for Shopee is stipulated in Article 45 Paragraph (2) and (3) of the Electronic Information and Transacactation Act.
